Wrong, wrong (no offense). The county changed policy about 15 years ago and has issued restricted licenses ever since.

One year ago, Judge Reitz was elected and the word is that he is pro-civil rights and will remove the restrictions recommended by the county if you ask.

(How do I know this? I am a lawyer and I know people in the Putnam County attorney's office...)

There is a provision in the Civil Rights Law (Art. 2, sec. 4) that contains the verbatim language of the 2A. It is not a constitutional provision but is a "civil rights" provision (as indeed it is).

Not that it matters -- the policy oriented NY courts would construe a state constitutional provision the exact same way they have construed the real 2A -- just as a sort of "collective" "right" that doesn't inure to the benefit of any particular individual.

Correct on both counts. I just find it interesting (sadly) that 1 of the 13 original colonies has a Constitution lacking a 2A equivalent. Then again, NY was rather pro-crown during The Cause. Maybe that's why.:mad:
 
disgusting! all of it! i'm disgusted from the president all the way down to the local dogcatcher. sometimes it seems like all the conservative people in this country have just given up, and all you hear about and or from is the liberal media making guns and gun owners out to be villans or outlaws. i am so sick of the term "gun crime".

I read about those proposed bills a few days ago. They are the same junk plus a few more that were proposed last year. That was when our state legislature totally fell apart so nothing got done. That was about the best we could have hoped for . This time we can hope for the same ineptitude but that won't go on for ever. I write and call just so our side gets some voice.
Reading those proposals makes my blood boil and shows me how ignorant the legislature really is.

Uhh, NO,NO.....Judge Reitz was elected in Nov 2006, and started signing "unrestricted" licenses in late 2007. How do I know this? Simple, Judge Reitz signed my "amended" license in Oct 2007.
Putnam County Judge Reitz routinely issues "unrestricted" licenses, the only folks who get restricted ones are new applicants.
 
Correctomundo. Reitz has been in office over 3 years now, and has taken over licensing duties. Judge Rooney has let Reitz do all the firearms related paperwork.
Paper licenses are still the rule here also, no cards.
Our licenses are for life, they never expire, we pay no yearly fees, only $3 when we buy another handgun.

Are you sure? I know the understanding I got from the county attorney's office was that per the direction of the county legislature, the sheriff was recommending restrictions on all licenses, and the judges were virtually always rubber-stamping it. I was specifcally told that Judge Reitz's arrival was the factor that changed things. <shrug> I only know what I hear from people. I would certainly be pleased to hear that the general issuance policy in Putnam County has changed for the better.
 
Sorry I got the year wrong -- I don't live there (I'm in Dutchess). Is Judge Reitz issuing unrestricted licenses to qualified applicants on request, or is it a "maybe" thing? I definitely got that all new applicants were receiving restrictions. What are your chances when you go in and ask for them to be removed?

What you've been hearing is false information. Judge Reitz WILL issue unrestricted licenses IF you ask for it. He's not sending out notices to come get it, but it's common knowledge around these parts that the "restricted" days are over for those who already have a license. I've only heard of 1 person(whom I know personally) who was not upgraded out of 700 or so. New applicants will still get a restricted license for some time period, but will upgrade at some time, and honestly don't know when.
The judge was elected with the help of a local gun club, and he lived up to his promise to ease the burden. Regarding the Sheriff, I've hear conflicting reports over the years. Seems the scuttlebutt was that the Sheriff was blaming the judges and the judges were blaming the Sheriff for denying the rights of residents. Hard to determine the truth there. I will say the sheriff has been to all of the local Friends of the NRA dinners and has been nothing but helpful and understanding of gun owners needs in the community. The sheriff has in fact donated items to be raffled at the dinners. And I've never heard a negative comment, regarding gun ownership, coming from his mouth.

Could have been a lot better too, IF the ALLEGED friends of gun owners and sportsmen had voted down the NYS AWB in the first place.

Hi, researching this topic online brought me to this forum as a new member. I'm in Putnam county, have had a "restricted" pistol permit and have a hearing next month before Judge Reitz to petition him to remove my restrictions. I've heard little about what goes on in these hearings except a recommendation from a sheriff's department pistol safety instructor to not tell the judge I just want the restrictions removed for the heck of it. He wants a reason. Not sure what he wants to hear. Anyone with any experience on this matter? Any help is appreciated.
 
Jibber, be calm be clear be respectful when going before the judge. He IS a good man, and you WILL have your restrictions removed. Just don't show up with a loaded G19 with hi-cap mags.;) In fact, leave the gun home, you will be going thru metal detectors, and besides, NYS law does not allow guns in Court buildings.
Don't blab on about "it's my 2nd A right" and all that stuff, even though it's true.;)
If you have any other licenses from other States, called non-resident licenses, make him aware that you have them. It will help. If you have not taken a safety course in some time, do so asap. If you belong to a club, such as Putnam Fish and Game, let him know, it only helps.
Any volunteerism you do in the community is a plus.
I know some will scoff at these suggestions, but this is reality in NY, anything to achieve the goal is recommended.
Other States, too, require some sort of "approval" process before issueing CCW's.

Jibber, the previous advice and postings should get you thru it, it's really no big deal. The judge will put you at ease, if that's possible. I know it's normal to feel anxiety appearing before a judge, but at least this is not a criminal hearing.
After you're approved/upgraded..whatever you want to call it..thank the judge. A little smile and thank you will be remembered by him.
Last, but not least, we need to work/help the judge get re-elected. Last thing we need is some anti-gun judge undoing all the previous good. Contact me if you need some help/guidance, I'd be more than happy to assist you.
