So I have been looking for a rifle to hunt hogs and deer. I got a good deal on a used Marlin yesterday (it sits in florida gun jail until the 20th). I need a scope recommendation, I am thinking 3x9x40, something good for a guy on a budget. Thanks in advance for any help

Have you considered a scout scope set up? XS makes a rail for Marlins that you can forward mount a scout scope on, although most of the longer eye-relief scout scpoes tend to be a little pricey, e.g., Leupold.
 
I just bought a scope for my Marlin 1895 SBL 45-70. The Bushnell Trophy XLT in 3-9x40 and a set of medium Weaver rings ran right at $200, tax included. Nothing fancy but a large enough lens for these old eyes to see out to a couple hundred yards easily enough.

Bushnell is offering a 12 month money back guarantee if for any reason you do not like the scope.
 
On my 45-70 Guide gun, I have a Sightron Red dot. It is well made and Sightron has a lifetime owners warranty, but they prefer that the gunshop take care of you right now instead of return to factory! The model I have may be out of your price range but at least give them a look. The red dot scopes are usually zero magnification and fired with both eyes open. This helps in low light conditions. The dot is adjustable for both brightness and shape ( dot size, circle, or triangle) and zeroed like a normal scope. They do use batteries, but if you maintain your scopes like you should your rifle it isn't an issue (buy spare batteries and install at a regular intervals or after extended use!).Since Red Dot scopes are normally no magnification the can be mounted at either close or mid eye relief. By the way on scopes that are full size but say Rim Fire, the difference is the parallax is adjusted for 50 yards on RF and 100 yards on center fire. Ivan

Probably a pawn shop trade in. All items guns or otherwise need to do a 30 day wait in the hole to see if they are stolen, The items upload on the pawn shop system to the pawn Cops.

Even if I trade in a gun I bought at the gun/pawn shop with my original paperwork on another gun, they can not sell it for 30 days. It may be a murder weapon:rolleyes:
 
To me a 3-9 x 40m/m seems out of place and ugly on a 30/30 lever action. If that is what you want then you already have some good suggestions but a 2-7 x 32m/m should have MORE than ample magnification for that gun and they are lighter and cheaper. A Weaver Kaspa is about 80 bucks or a Redfield or Burris is about $140.
 
I think I have too many toys, I forgot I have a 4x32 shotgun scope I think that should work. I am not expecting to make shots beyond 150 yards
 
That 4x shotgun scope should be fine. My first rifle was a lat 60s 94 Winchester that I mounted a 4x Weaver on, and it was great! Right now my Guide Gun is wearing a 2-7 Leupold.
