Need info. on Calf. gun ownership

I hear all sort of rules and laws that effect handgun ownership, my question is, if I fly to LA to visit my brother what handguns can I leave with my brother who lives just outside of LA??

I'm thinking about such old friends as a .45 auto, Mod. 19 S&W or a Glock 17. What does the state of Calf. say about common handguns like these???

10 round mag only.....A father can pass down a weapon....If anyone asks you gave guns to dad, dad gave to brother..As long as he has no felonies and could pass a Background check to buy a piece you should be fine.
 
Nope!!! You will have to go with him to a gun shop and do a person to person transaction with him. That will likely cost about $45-$60. To find out what guns he can have, type in CA DOJ Handgun roster in google and follow the link. It lists every gun that can legally be transferred in CA. I am not positive that you can even bring them here and transfer them if they are not already registered in CA. Your best bet would be to call a local gun shop where he's at and ask them.

The list only applies to guns being brought into the state, not only new guns. You may bring off list guns in if you are moving here. I repeat: If they are not on the list, you must move here and establish residency to bring them in. To bring them in otherwise is a FELONY.

Since us residents of the PRK can't all give you the same answer, you really need to contact the California Department of Justice-Firearms Division. I would do so by email, and keep the corespondance for your records.
 
Flying...handgun not a good combination.You would be better off having your ffl dealer send the handgun to a ffl dealer close to him for the legal transfer.
 
I haven't lived there since '05, but this is what I remember. You can't simply "bring" the guns into the state to give to your brother. You'll have to go through a FFL and do the DROS, etc. The advice of saying the guns were given to your dad, etc, is very bad advice. That constitutes a possible felony and both you and your brother will lose your gun owning rights for life.

The Glock is ok, as long as it has magazines no larger than 10 round capacity.

The model 19 is not on the approved list and cannot be given to your brother. It can't even be brought into the state by you unless you're moving there.

I can't say about the 45. I have to know the exact make, series, etc.

Definitely do not fly into kalifornia with firearms unless you know for a fact they're approved. Like I said, kalifornia takes this stuff very seriously.
 
You can bring the handguns into CA with you and take them back when you leave. Hi Cap mags and all. When I moved here I called the CA DOJ firearms division and spoke to Bill and another gentleman. He said that the rules are written for actual residents of CA. Since I am only stationed here for short term, 4-5 years, and am not setting up residency here the rules don't apply except for the EBRs and others that qualify as assault weapons. I have all of this in e-mail from the DOJ but it's at work. With all of this being said, I would still not fly into CA with guns just because you'll put yourself through more hassle than it's worth. As mentioned before, call the DOJ at (916) 263-4887 and speak to them for better answers. I have called them on several occasions and they have always been professional, polite and very helpful.

Wow, I had no idea. I knew California was fruity, I didn't know it was that fascist. A 10 round Glock is OK, but a Model 19 is not? I know these tyrants don't know guns, but....amazing.
 
Thanks for the help fellow S&W forum pals, that makes it all clear as mud. Boy, what a mess to giver my brother common handguns.

Here in Illinois is not gun friendly, but at least nothing is Banded at all. Just no CCW or form 4.

And this all represents the confusion I was in anytime I left the house with a gun. They were changing the laws so often and so quickly that I was having to call three or four LE agencies to find out if I was legal.

Mtnbkr says the OP can go into the state with hi caps, and all, but I think that's bad advice. The reason being is that kalifornistan cops aren't the brightest folks on earth and don't know the laws themselves. (At least, that's what they would tell me whenever I called.)

So if the OP takes a hi cap or otherwise disallowed firearm into the state, and for some reason some greenhorn cop finds out, the OP could be in for a real bad day.
 
Just keep your nose clean and do what you want. I would rather drive them in instead of fly them in.

I saw a memo recently sent by Sacramento Police Department to all it's officers on the assault weapons ban and the "Bullet Button" AR's. Basically it said do not arrest anyone that has an AR with a "Bullet Button" on an assault weapon violation because we have no idea which ones are legal and which ones are illegal. The lawyers are working on it.
It's not that the cops are stupid, it's that the laws are so poorly written that they (or anyone else for that matter) can't figure them out.
For those who don't know a "Bullet Button" is a device that replaces the mag release on an AR. It prevents you from pressing the release with your finger, therby giving you a "fixed" magazine, and therefore a "legal" AR. The mag is released by using the tip of a "bullet" (.223) or something similar in shape and size, like a pen or an icepick, to press the "button" throught a small hole. This suposably satifies the "tool required to remove the magazine" requirement of the law. But there are other issues to consider, like colapsing stocks, pistol grips, flash hiders, & bayonet lugs, to name a few. Then there is who made the AR in the first place. If it says "Colt AR-15" on the side of it it is illegal, no matter what.
