The order will direct Attorney General Merrick Garland to ensure that gun sellers “who do not realize they are required to run background checks under existing law, or who are willfully violating existing law, become compliant with background check requirements,” according to a fact sheet released by the White House.
That's about as vague and ambiguous as anything else I've seen from the same source...:rolleyes:...Ben

Well... To me, this reads as: 'Do Your Job and Enforce Existing Laws'... as opposed to trying to use an executive order to create NEW laws. [Shrug]
"Cabinet to partner with law enforcement, health care providers, educators and other community leaders to encourage the effective use of red flag laws in the states that have them."
Now what could possibly go wrong with this one?
Ever wonder how (truly) mentally unstable shooters fall through the cracks in the system? Many patients who could become a danger to themselves, or others are many times NOT reported to the Database due to the gray area of being a HIPPA violation. As an Executive Order would supersede HIPPA, it could ease the fear of HIPPA Violation suites.
But yes... this part could very easily turn into a '1984' 'Big Brother Is Watching' situation... Anyone diagnosed with PTSD, ever been on Depression meds, etc., could theoretically be put on a Red Flag list.

A slippery slope, unless everyone reported to the list is given a fair and impartial hearing BEFORE being put on the list.
 
The ATF has started revoking FFL licenses for minor clerical errors. In the past, that was a fine or other minor level action.

An executive order CAN NOT supersede a federal law. In this case, it's an attempt to implement a work around.

Among the other things you don't know about HIPAA is how to spell it. There are emergency exemptions in the law when it comes to public safety.

No it can't. Executive orders don't overrule law. If that were true, our guns would be gone.

EO’s apply to the Executive Branch of government and as such are not laws in and of themselves…….however, they can direct regulatory agencies of the Executive Branch to re-examen their rules and regulations (to what end and what purpose?) which is what this proposed EO appears to be doing……

EOs only apply to the Executive branch. Regulations can only implement the law as written, not re-write law. West Virginia vs EPA was a huge win.
 
So what's with the background check game? If someone can't be trusted with a FA, why trust them with a driver's license, a sharp spoon, a Louise Lasser light, a voter registration, a walkin' stick, a crack pipe, a steel toed boot, ...

So vague that is seems like an excuse to harass FFL's and private sellers.

I love how the plan is toe "crack down on FFLs who break the law" but there seems to be no plan to crack down on actual criminals. And the request of his enforcement bodies to make sure FFLs know they have to run background checks. Who does he think doesn't know they need to do that?
