Insurance policies routinely exclude coverage for criminal acts. Homicide is a criminal act.
Homicide is simply a catchall term meaning the killing of a human being! There are several differentiated types of homicide, definition varying state-to-state. Homicide and murder are not synonymous!
1) There is Criminal Homicide, which includes all degrees of Murder and Manslaughter. There are degrees of Manslaughter that may or may not be criminal acts.
2) There is Justifiable Homicide, which includes legitimate self-defense. This is not a criminal act.
3) There is Excusable Homicide, a killing pursuant to the execution of a legal sentence of death imposed by a competent court of law. This is what protects members of the team participating in the execution of such sentence resulting in death of the condemned! This is not a criminal act!
Again, these definitions differ state-to-state, but the principals are the same.
Just an aside. When a murderer is put to death, by any means, it is the sentence of death that is executed, NOT the person. I wish the news media could get this straight! Fat chance.
Now, the Insurance Agent side! You are covered under your Homeowners policy for negligent acts resulting in injury or death to a person, or damage to their property. This always applies unless there is specific policy language excluding specific acts or means! Why no one seems to understand this I cannot understand. This is a basic principal of Insurance!
