New Model 41 ???

I went to pickup my new Model 41 tonight and was disappointed when I looked over the pistol to find a two areas on the slide had about 5-6 tiny pit marks and the slide release had not taken to well to the blueing and look as if were starting to rust. Upon turning the gun upside down I noticed on the frame under the slide there was a small piece of shiny metal as if it were chipped. I did not sign the 4473. Am I being to picky, I'm expecting the model 41 to be damn near flawless. What's your take? By the way, the date on the fired casing envelope was 1/10/12.

Yep Im with ya. I like a darn perfict gun whenever I purchase new. For what Smith gets for the new 41, I would want a darn nice one. Hold them to a high standard, and get one worth your liking.
 
I don't see how that is picky since that condition sounds worse than any new gun I've ever seen. My experience buying new guns is that they generally are flawless, even at lower price points. Minimum expectations are that the gun should be in average new gun condition, which it sounds like yours isn't.

The question in my mind would be whether it will take longer to have the gun replaced by your dealer or whether it would be longer to accept the gun and send it back for service.
 
The used M41 (about 1980) I recently purchased sounds to be as good or better than your new one. You are most certainly not being too picky; you are paying for a new pistol, you should be given a new pistol.
 
I agree with you and the others. S&W needs their feet held to the fire on quality control. New guns should be properly finished, and especially a top of the line target pistol.
 
I took delivery of a new 41 about two weeks ago. It was what you expect a brand new 41 should be, perfect condition. Also, ran 200 rounds of cci standard velocity without an issue. I love it! I suggest you not accept and have them get you another 41. Good luck!
 
First I've heard of 'new' one's being available as they've been out of stock for quite some time. But as to the OP, if it's all dinged up the moment you take it out of the box you did the right thing by not buying (or doing so with a steep discount!). The used 1997 era 41 I bought sounds to be in better condition than this one...

These were 'regular' Model 41's and not Performance Center jobbies?
 
My 41 (1970) is a work of art ,l I would not accept anything less from a new one. It came with a 7 1/2 barrel and I bought a 5 now I have the best of both worlds.
Don't accept any substandard new gun ,they will learn their lesson.
 
Maybe a "new" gun that someone returned? In any case, I would expect it to be perfect and would insist on a replacement.
 
It depends if you paid "like new" money for it, or did you pay "used" money for it.

EDITED to add: are they making these again?
I had assumed this was used.
 
Visited S&W in Springfield Ma on friday. Asked the guy about a new 41, told me they were taking orders for the middle of 2013 sometime. I would not hold my breath looking for a new one.
 
There has been an occasional new one on GunBroker and GunsAmerica. I went to Bud's Guns and asked to be alerted when they got one. It took three weeks, but they got one in and I bought it. Should be here Monday. Also, when I called S&W customer service a few weeks ago, they stated that they are shipping them from time to time and that they had sent about 10 to RSR (a large distributor) over the prior 6 week period as well as a couple here and there to other distributors.
 
I purchased the 41 from Bud's last week. The build date like I stated was 1-10-2012. They had 6 left after my purchase. Bud's sent a call tag to my ffl within an hour after I called them. They told me it would be a full refund.
