NJ suspended NICS check till further notice

National Instant Check System

As all gun sales in NJ must go through FFL and FFL must run a NICS check, all gun sales(except those already applied for) are prohibited till further notice

The Governor closed all gun shops in PA starting this past weekend. A gun shop in my neck of the woods filed legal action challenging the Gov., citing a variety of 2nd amendment issues. It was thrown out by the court, and said gun shop is now closed, as are all, until further notice. Only "life sustaining" businesses are open....Including beer distributers.

NJ. does not directly use federal NCIS - but runs checks thru a state police data bank that is linked to feds - federal system is still working but is getting backed up with volume of requests - the NJ system does not operate under same guidelines + is not available on same schedule as the federal NCIS - it is controlled by the NJSP + the state attorney generals office -

I read somewhere that the 2A Foundation filed suit on NJ.
Probably be awhile before anything happens.
CA did the same with gun stores. At least the LA sheriff.

Yes, upside down country we are now living in... I honestly never thought I’d see the country go this far off track. Sad to see...
 
I wouldn't say we've gone off track just because you can't get busted for possession anymore. Also, the states get ridiculously high taxes off sales, far more than booze which costs society far more, even if you only count collisions in which alcohol was a factor.
 
This could be a practice run for a later gun/ammo sales being
verboten for whatever time period they choose. Other states
may be watching this and will follow suit.
The question is just how far can we push the public and they
still comply.
 
Here in WA, effective at 5:30 tomorrow, all locations that sell firearms and ammo will be shuttered for at least two weeks since they are not on the list of "essential services".

Since all gun sales must go through an FFL this effectively halts all sales of firearms as well as retail sales of ammo (you don't need a BGC to buy or sell ammo here - yet).

I've got two "in the pipe" and theoretically the BGCs are still being performed for sales prior to the shutdown. I've spoken to both FFLs and they say they will still be calling people to come in by appointment only to complete their transfers as they clear the system.

Now that they have set this precedent, I have to wonder how frequently we will be experiencing these kinds of "emergencies" in the near future...

It's not like possessing pot is constitutionally protected. As far as using MJ it shows in your blood for up to 30 days or so. How many drive under the influence of it? And don't try to ignore the fact that under the influence of drugs doesn't cause the same results as alcohol. Being able to buy use possess firearms is protected by the 2nd Amendment and if the gummit is ignoring that it truly is wrong. If the states or other governmental entities can stop the sales now...will they ever decide to allow it again??? Be a little untrusting when they say...trust me!!...If you honestly think the train is still fully on the railroad tracks...I have a bridge I'd like to sell you.

Fresno CO & Fresno City have said they will not close gun stores - but I don't think they have any inventory left
 
Over 13k people waiting for background checks in Colorado when I left work today. Checks are taking better than 4.5 days. We too use a state system instead of NICS. How long are NICS checks taking in the free States?

The checks I've done in the past week or so have ranged from immediately to delayed and then cleared in 1 or 2 days.
Biggest problem has been being on hold for extended times. I don't do it online.

NICS IS available, it is individual states information and/or systems that is not.

You are correct for much of the USA but not for New Jersey.

In the rest of the country an FFL can log onto the FBI administered NICS and run a check. It might take a while for the results to come back but eventually they will and the transfer can proceed.

In New Jersey the NICS is unavailable by government order. Because New Jersey recently made private gun sales illegal, the fact on the ground is that by shutting down NICS in New Jersey the transfer of guns in New Jersey is now illegal.

How long are NICS checks taking in the free States?

I don't live in a free state but my NICS check in NY yesterday took about 3 seconds from the time my FFL hit submit.

He did say he's noticed more delays lately.
