Outrageous sales practices -

As Jim Watson said above - S&W has a compliant version of the Bodyguard 2.0 available with two 10 magazines, for all the states that limit capacity. It's S&W SKU 14192 and only comes with a TS. A dealer should not be offering a non-compliant SKU to a buyer in a restricted state.

I see those disclaimers all the time on gun ads. If there was no notice, then they owe you a compliant mag or a full refund. If you just missed the notice, well sucks for you, I guess. The 15% is a pretty big hit.
 
I think Buds is the only site I have ever ordered from that will swap mags. Most have conditions they won’t swap mags and if the guns not legal in your state, there’s a restocking fee.

Technically, they could still ship it to your LGS since the 12 round mag is legal for an FFL to have but most don’t know that or won’t do it.
 
How about letting the rest of us here on the Forum in on who the vendor is in this situation. I can't think of a good reason NOT to. I, for one, would not buy from a vendor who tried to extort money from a buyer after a purchase. You'll be providing a public service to us.

I can tell you live somewhere that isn't Las Vegas. Out here at the ***-end of the supply chain, that 'little bit extra' often takes us over the MSRP by quite a margin.
 
Don't order a gun SKU that you know is illegal in your state.

If you do order an illegal item, expect a dealer to:
  • cancel your order, or;
  • at the very most, remove any illegal item from the package.

If you have ordered an illegal item, do not expect a dealer to custom build a package to your previously unstated expectations at the same price as a legal off-the-shelf product.

Things would have been simpler if you had done a little more homework.

You could have found a legal product SKU on S&W's website and bought that product rather than a product that contained illegal components.

Or you could have contacted the on-line retailer and asked how they handled products that contained illegal components.

But you proceeded on assumptions ...

No returns on ammo nor guns is a normal policy. For guns with a warranty, some dealers will ship it back to the manufacturer as a service for the customer. Gun shops usually don't work on huge profit margins.
 
I work for a local FFL doing gun shows. Nobody buys factory direct unless they are buying massive quantities. We buy from gun distributors. Different states have different requirements. So the factory has different SKU #’s for different packages that are required for different states. Free states, one SKU # with 2 hi cap mags. Live in NY, different SKU for lo cap mags, & NY trigger. Another state may allow normal trigger, but lo cap mags. So there’s many SKU numbers for every variant. So a few years ago during Covid with the big rush on guns, there was a shortage. We could only get Glocks for a commie state with 10 round mags. We were told it’d be 6 months to get the SKU for the hi cap package. So we sold them face to face with the customer inspecting the gun before paying. They’d come to the store a few days later demanding their hi cap mags. We told them “you inspected the gun, & accepted it as is”. At least they got 2 mag. We’ve also gotten AK’s with underfolders that were meant for NY, & didn’t fold. But in our case, we’d offer to sell the customer a new hi cap mag still in the blister pack, but they weren’t getting it for free. In the OP’s case, he knows he lives in a commie state, & should expect what happened. GARY.
 
First, sorry your state does that to you.

My only question is, does the vendor you purchased from advise buyers up front that they will remove any prohibited magazines from the package without a replacement? If so they've done their part. Like others have said, post up the name of the company so we can see for ourselves.
 
Won’t be right to put the cc company on the hook for this. Unfortunate situation on both parties.
