pistol brace "banning" question

By the time there is complete legal clarification on this matter, we most likely will have had a national election. Hopefully, the current administration will be shown the door!

When it comes to the ATF, I like to know the rules.


Taking them across state lines.

Application to Transport Interstate or to Temporarily Export Certain NFA Firearms (ATF Form 5320.20) | Bureau of Alcohol, Tobacco, Firearms and Explosives.


Removing them from the NFA Registry.

ATF NFRTR Letter Requesting Removal of a SBR/SBS Title 2 Status Genera
– National Gun Trusts
 

I do not currently own any NFA items, but if I did, and I plan to get 2 suppressors, I will print out any appropriate ATF laws or letters, and put them in my rifle or pistol case with the item. This is above and beyond any tax stamp paperwork proving I legally own the item.

I keep copies of all my tax stamps in all 4 of my range bags/cases.

You can legally travel to any state that allows suppressors without filing any ATF paperwork. They just require it for SBR, SBS, and machineguns.

Hey-The point I was trying to make is that an SBR can't be made into a pistol again by merely removing a stock or whatever. As long as it's registered as an SBR it is one. But you can decertify it. The bad news is it really requires another tax stamp to take it back as I know you agree. As far as taking it over State Lines, I really don't want to clear it through some clerk at the ATF, but I'm happy to know that's an option. Thanks for clarifying that for us.

I have to respectfully disagree.

You are not required to get another stamp to un-stamp a SBR.

I can take any 3 of my SBR AR's and slap a 16" upper on them and be done with it. As the ATF themselves say here.

"It is not a requirement to remove your SBR from the National Firearms Registration and Transfer Record (NFRTR); however, ATF highly recommends you notify the Government Services Branch (GSB) of the National Firearms Act Division to remove the firearm from the NFRTR registry. All NFRTR updates should be emailed to [email protected](link sends e-mail).

Notice the ATF does say they "highly recommends you notify the Government Services Branch."

I would absolutely notify them, but there is no Form 1 or stamp involved.

I'd use this if I wanted to remove mine.

Ya really ought to consider reading the posts/rules/laws a little more closely. Imo, there is a distinct difference bout removing the sbr classification depending on whether you started with a pistol or a rifle. If you started with a pistol , it is fairly simple to return it to pistol status. And it doesn't require another stamp or application.
