Preliminary Injunction Issued in Illinois

Today, a federal judge for the Southern District of Illinois issued a preliminary injunction that blocks Illinois’ ban on more than 170 semi-automatic firearms and magazines over certain capacities. The law took effect on January 10, 2023, but shortly after, lawsuits were filed in state and federal court.

“We want to thank Judge McGlynn for issuing his ruling today,” said Richard Pearson, Executive Director of the Illinois State Rifle Association. “We have said from day one that this law is unconstitutional and infringes on the rights of legal firearm owners in our state. As the leader in protecting 2nd Amendment rights, we will not stop supporting our residents and their constitutional rights.”

a tiny step towards correcting the egregious crime commited against the citizens in many states, most recently Washington. I got an e-mail just now for an internet store proclaiming they are now shipping mags to Illinois.

here is the part that gives me hope

"Can the senseless crimes of a relative few be so despicable to justify the infringement of the constitutional rights of law-abiding individuals in hopes that such crimes will then abate or, at least, not be as horrific? More specifically, can PICA be harmonized with the Second Amendment of the United States Constitution and with Bruen? That is the issue before this Court. The simple answer at this stage in the proceedings is “likely no.”

this quote pretty much applies to any state or city ban as far as I can imagine.

I expect to see a similar ruling in Washington State anytime now. If we don't then the SCOTUS will handle it.

The various States have decided that they can do this despite Heller, MacDonald, and Bruen. Lo and behold! The Federal courts tell them that they cannot but nice try, idiots...... :rolleyes:
 
In Pittsburgh, our past mayor tried to spearhead a law to ban semi-auto rifles and +10 capacity magazines. Coincidentally after that Synagogue got shot up. Nothing happened; their lawyers said they would lose and it was dropped...or something like that. Years back up in my neighborhood, 3 police were killed and a fourth wounded before the shooter was taken into custody. There was not one mention that I can remember about banning semi auto rifles. All that came of it was 911 operators were required to ask the caller if any guns are present, as these poor police were ambushed by the shooter holed up in his house.

Seattle 911 operators ask that now too, as do responding officers. We had an incident a few years back, and they asked us, and I said they were all locked up. That seemed to ease their minds, as did our calm behavior.
 
The odds are that if I am concerned enough to call LE at home, I will be armed. I stay on the phone, or tell them to call when the cops are near and I will come out without the gun. I am not dumb.

Oh, absolutely. I think so often "innocent" people being shot by law enforcement are behaving as a threat in some way, and NOT effectively communicating with law enforcement on the scene.
 
I'm in TN.
A drunk driver was being chased by our local PD a few years back, and he missed the curve in front of our house and ran up a bank into a tree. I walked out in the yard with my hands clearly visible well above my waste, palms forward, and simply told the officer that I live here, I'm an NRA cert instructor, and I had his 6 until backup arrived. We gave each other a nod before he approached the car. Several cruisers were there a minute or so later and I went back to sleep. That's how not to get shot as a good guy with a gun around cops.
 
OK. 2 different lawsuits in Illinoise, 2 different districts, but in one, the Illinois government just drew the direct attention of Supreme Court Justice Barrett, as the supervising Supreme Court Justice for that district.

Short answer is that Justice Barrett ordered Illinois to brief her and the Court exactly how their ban doesn't violate the 2nd A. They have to file their brief by Monday at noon, DC time, Thats May 8th 2023 for anyone looking back on this. So Justice Barrett is expected to respond to the brief by the end of next week. Friday May 12th? or possibly the following Monday.
