...about his visit to his oral surgeon. This brought out the Gemini in me. One of the listed traits for Gemini folks is that hey can sometimes see both sides of an issue.

When I read Kevin's post I immediately sided with him partially because of an experience I had which I will elaborate on later in this post. But as I read through the responses I was able to see the point they made as well. Kevin may have over reacted, I guess it isn't up to me to judge but his response was certainly understandable, whether or not it was appropriate.

I will relate my experience here and throw myself on the mercy of the court. I am not a confrontational person. But I do have some limits to what I will put up with. If/when something pushes me past that limit I react. I think we all have our limits and I like to think that I'm a reasonable person and not a hot head.

Years ago when the cable tv industry was in it's infancy I signed up with a company and paid a $25.00 deposit on a "box". After a time we decided to discontinue their service. I returned the box at the location where I picked it up. I was told I would receive my deposit money back in the mail. No problem-0.

this was in the middle of September. The rest of that month and all of October passed and no check came in the mail. In early November I went in and inquired about the status of the check. I was told it would be in at the end of the month. Fine.

November passed and still no check.

A week before Christmas I went in and was told it would be in by the first of January. Fine.

Sometime in the middle of January I had had enough. I know it was only $25.00 but there was a principle involved here.

I went in and told the lady I would like to have my check there and now. She said that they didn't do that. I would have to wait for it to come in the mail from the home office. I explained that I had been waiting for several months and been through a lot of aggravation and that I no longer believed that "the check was in the mail". Again I stated that I wanted my deposit returned then and there.

She disappeared and the manager came out. He also explained that they didn't return deposit money there. I pointed out that it wasn't being returned anywhere else either.

By now we were both angry. The place was full of people waiting to sign up. I told the manager that I was leaving there in one of two ways: with my $25.00 or in handcuffs.

He couldn't believe I'd go through all this for $25.00. I explained that it was no longer about he money. I was tired of being lied to and pushed around and nobody seeing to the problem.

He stomped back into his office and I sat down to wait...for him to come back with my money or the police to come in and haul me off to jail. People were leaving from all the commotion and I really didn't know what was going to happen nest.

Eventually the manager came back and handed me a check. No apology or comment of any kind. He just turned and went back into his office.

Epilogue:
2 weeks later my refund check came in the mail. I had to laugh. I thought it'd serve them right if I cashed it even though I'd already cashed the other check. But then I'd be even more wrong than they were. So I decided to just tear it up rather than send it back. That way they''d have to carry it on there books for a while and hopefully be a hassle for them.

SO...what's the verdict. Did I over react? Did I give them time to take care of the problem? What say you? How ever you decide I do still feel that I was patient and gave them ample opportunity to take care of things. Would I do the same thing again? I honestly don't know. I might.

Talk about feeling jerked around...we sold my mother in law's home after she passed away. Filed the inheritance tax return and provided the closing company with the receipt for the $19, 000 or so in tax. They withheld a little over $37,000 in escrow until the state approved the tax filing...7 months later we finally get the escrow..released. I asked them about interest on the money, and they told me the escrows are held in non interest bearing accts....i worked hard to not get angry, and may have been just a little testy at one point...generally though, I find that calm persistence wins the day. When i yell, no one listens, when i whisper with an edge to my voice, people pay attention.

I don't think either of you are necessarily wrong. Your case would be far more annoying than the oral surgery case. In your case it had men months of lying. Business that lie to me really frost my rear.

In the other case the woman wasn't lying, but was being extremely rude. Besides the pay at service part should have been made abundantly clear before anyone ever arrived at the office.
 
My family had rental houses and apartment complexes since I was in first grade. We took pride in giving a freshly painted cleaned unit with clean or new carpet to every customer. The number one thing people get deducted from their deposit is dirty carpet. Very often they ask how much that will cost before they move out, and find that the charge by the company we used is less than they can clean it themselves. How ever there are always disagreements, and we have a court system to figure those things out.

One unit sticks in my mind. The unit she wanted was in need of new carpet, and we agreed to allow her to choose the color from our normal line up. She didn't want any of those, she insisted on White! We said no! She could choose on of the other colors or feel free to live somewhere else! For some dumb reason the rental agent allowed her to after all that, choose white!

Our leases were for One Year, and then Six Months auto renewal after that.

She moves out at six months and ruined the carpet. There were red wine stains throughout the Dining Room, Living Room and the Bedroom. So we kept her deposit and billed he for the remainder. So you guessed it, she sued for her deposit back.

Even though it is civil court, you are under oath! She told the judge that the carpet was ruined when she moved in and that is why she had to break he lease. When it was our turn, we presented the bill for the carpet all dated two days before her move-in date. (This really isn't enough to sway a judge to find against a voter!) But when we showed the photo of her standing on the brand new carpet with the address visible in the photo and a photo of the carpet from the same angle after she destroyed it. The judge was furious! He ordered her to pay us, "You have 30 days to pay but better do it quick, because I'm having the Prosecutor file perjury charges!"

She paid us that day, I don't know if she went to jail; but I hope so!

If it were in an interest bearing account there would be some who would put it in an account with risk. I see your point but you would be even angrier if they told you the market changed and your $37,000 was now $30,000.

OP - Likely in your case that manager normally couldn't issue refunds, but his boss(es) got the phone call about this really disturbed guy in the office driving customers away, and he was suddenly authorized to give you your refund. Folks at this level normally take info and payments in, then pass it all up the chain. No telling what happens when you confront someone to make a decision who has little or no authority to make any decisions outside their job description. If it was their procedure to issue a check it would have happened right away. But somewhere up the chain someone can make a quick call and get the job done. That's who you need to talk to.

I'd have waited 2 months for the deposit. Then during the 3rd month I would have elevated the supervisory level phone calls until I got someone to commit. If necessary every few days I'd go up the ladder, telling succeeding supervisory folks how I heard of someone who waited months (not a lie, I read your post) for their refund and how I won't stand for that type of suddenly and surprisingly poor service. Be nice, polite, firm, not mean, vindictive, ugly. Phone calls are cheaper than repeated trips to an order entry office.
