So very tiring, judges and politicians doing what they want, not what is right. Doing what they want despite being clearly in violation of the intent and frequently the letter of the law.

Reminds me of the disgusting former Chief Justice of the CA Supreme court who, despite an overwhelming vote by the people to allow capital punishment insisted that no one would ever be executed while she was in office.

Excellent, one judge saying the votes of millions are irrelevant because she doesn't agree.

In the case of the NY judges, they should be removed from office. Don

Evidently wide popular support either does not exist for the recognition of more expansive self-defense rights in NY or at least in NYC, or at the minimum the politicians aren't convinced, or this wouldn't have to go to court.

I hope the SAF has picked a good case to push. Everyone should remember that Heller-McDonald was about self-defense in the home. We have yet to see how the SCOTUS would opine about CC in general. If I were to speculate it would be that a lot of what I consider "unreasonable restrictions" would be considered "reasonable" by many judges.

Why do I say that? Because the judges went to the same law schools and were taught by the same professors and in many cases selected by same politicians who made the laws in the first place.

If we want different results we must elect different people.

Thanks Roger, and all, there ARE some 2nd Amendment adherents/proponents here in NY, contrary to popular misconceptions fostered on the internet. I believe this case will be won, especially since it's been preceeded by DC and Chicago.
Unfortunately the left never gives up, even when they lose a court case, and the many battles have just begun. The left continues their mantra of "reasonable" restrictions and will do so until we get some sort of clear ruling from the SCOTUS. That case may never come up, and we should be prepared to fight the fight for the forseeable future.

It seems to me that public opinion may be changing in NYC at least among those who do not consider themselves the "elite". Unfortunately public opinion will have an impact on how hard the politicians try to keep this stuff going.
Too many states are essentially run by the Big City politicians getting away with as much as they can, think Chicago and downstate IL.
I would hope that some challenge is also being made to the Sullivan Act and similar restrictions on the basis of the "fundamental right to self defense" in the home recognized by the McDonald. This kind of challenge should be relatively clear sailing. As I understand the NY State laws on ownership, much less carry, the restrictions clearly are onerous.
What might happen as far as ownership goes is that a fairly rapid retreat might take place in view of Heller/McDonald; we could see a series of laws/regulations set-up and struck down as the retreat turns into a rout.

Carry, both CC & OC will be a long tough slog without public opinion on our side.

I'd still like to know, which phrase contains the words 'in the home'. Yet a majority of people seem to accept that as either reasonable, or 'the best' we can get. It says keep and bear, that means carry as well as own. It don't say a word about 'in the home'. And most of the guys at the talks, deliberations, and signing of the constitution etc, were carrying at the time. If not firearms, cause they weren't that good, they had sword canes and other means to protect themselves.
 
Good for the SAF The fine people in NY State need to change their laws so the elect their Judges like we do in TX. Judges in TX toe the line lest they get voted off the bench.
 
PDL It matters very little what you and I might think, it matters a great deal what the SOTUS says. This battle should have been fought out starting about 1910 when the progressives started their big controlling government squeeze; it was not, so here we are.
Back in my Grandfather's day (born 1865) the RKBA wasn't even questioned. Now the progressives have strokes over Heller and McDonald because they thought complete and total control was only an election away.
This fight is just warming up!
