Should I get a Lawyer

Short story, I had a slip and fall accident a week ago because of a non operating car wash. I had to exit my vehicle and push a button to open the door and I busted my ***. I have a bruise from my left hip-my knee,cracked my left upper forearm and put a few cuts on my right hand. No fractures but I don't bounce like I used to.The owners insurance company called me and asked me what happened. What would you do in this situation

First and foremost, don't talk to that insurance company in any way shape or form other than to possibly tell them your attornry will be in touch. Then, get an attorney!
 
I gotta be honest; the injuries don't sound life altering. If you had to go to a doctor and/or miss any work then you deserve compensation for money spent or lost. If there are no lasting effects, let it end there.
 
Well you have a problem on finding an Attorney.
All the good Attorneys are either hanging from a tree limb or at the bottom of the ocean chained together with 49 other Attorneys.
Seriously: I would tell the Insurance Company what happened and see what their reaction is.

A couple of bruises don't sound like a law suit to me. Then again, We've all seen some good ones. Hot coffee comes to mind.
 
Tell them you are okay,a nd what happened, ask them to fix their stuff. Maybe you get a free carwash or something, anything more would not be morally okay.

If you owned a bussiness, and something broke, someone fell, would you like to be sued?

It may be their fault, but there was a time when the company calls, you tell them you had a little spill, they say sorry and give you a free wash or two. Now EVERYBODY is LOOKING for ANY reason to sue, kinda sad.

I do however agree, it work was missed or medical bills were inquired, a little help from them might not be out of the question, but you are at fault as well, should have been more careful.

Not meaning to be a jerk, just saying I hate the word sue anymore.
 
I would suggest consulting an attorney. They are not the scum sucking thieves commonly thought.

There are many issues in your case at first blush. Some states have all but outlawed fall cases. There will have to be negligence on the part of the car wash and no negligence on your part.

Medical evaluations and prognosis will have to be considered. If you have a 30 day injury, it may not be worthwhile. Take the nuisance money the insurance company offers but negotiate with them. If you have the potential for a long term medical issue, then that is a game changer.

Lawsuits and lawyers would not be needed if insurance companies were fair with the injured. They do not care about the injured but only their profits.

I did miss 1 day of work and did not incure any medical bills because the company that I work for(private medical center) treats employee's for free.I have bills from the cleaners (covered in mud,soap and other stuff). I never said anything about a lawsuit, I just don't want to get screwed. I had to go to the business beside the wash to clean up and they told me that I wasn't the 1st individual that the wash malfunctioned on and they police were usually called to help get the trapped customer out of the bay. I had to go to the police department and get the contact phone number because the TEXT ONLY one posted ,got a smart *** reply.

They should be willing to pay your dry cleaning bill, I'd hope that could be handled without a lawyer?

I would try to be more careful next time. I'm glad you didn't break anything. Count yourself lucky that you wasn't seriously injured. Falls can be nasty.

I won't say which fast food chain but while eating a burger I bit into a galvanized 8d nail. No harm was done and I got free lunch everyday for a couple months. They offered to pay for any damages but there wasn't any.
 
I would take heed in the lesson learned and purchase some new shoes, more conducive to "wet" areas... with the insurance companies money, of course.

I had a burger once and bit into a small drill bit... I just went in to tell the king of burgers what I had found and walked away with my sore tooth. :(

If the machine would have worked without having closed doors then I see your point, but the bay doors close(BOTH ENDS) and the only way out was to exit my vehicle and push the emergency door exit button (the one under the sign that says push for emergency exit) There is no attendant on duty ,so if you fall and can't get up you are screwed
 
It's a car wash it's wet. Metal as a rule if wet is slick. If it's cold there's probably ice. Automatic car wash means you don't need to get out of the car. If it doesn't work leave it alone. I wish the sue happy folks had to pay for the trail and the metal anguish that the insurance companies have to go though. Maybe you should call the owner and appoligize for causing them the fear of lossing their business or their house and/ or peace of mind. Karma will eventually catch up with you. As far as falling but after you mentioned sueing the symphathy will only be found in the dictionary between sh*# and syphillus. I say delete your question before anyone else sees it. I've already marked your name off the party invite list. I think I'm going to need the extra money because my liability, worker comp, homeowners, health, and car insurance are fixing to go up.
