Text while walking in NJ = go to jail under proposed law

Texting While Walking Could Become Illegal In N.J. Under...

The law is apparently aimed at those in crosswalks, or maybe crossing a street at all. Should someone be caught texting (reading? sending?) it would result in a $50 fine AND a 15 day jail sentence.

I wonder if that would pass muster as a time and place restriction on First Ammendment rights? Could it also be made illegal to talk while crossing a street? What about reading or possessing a newspaper?

One day last summer a woman with a baby on her back stepped into the street without looking, it was around noon and the beach traffic was heavy, I stopped to let her cross, when she got in front of my she stopped to send a text, I gave her hell for not paying attention, with a baby on her back, her husband who had already crossed the street, picked up where I left off, I can't for the life of me understand what is so dam important. :mad:
 
People who want to text should stop whatever else they're doing, period. That includes walking, driving, riding a bike, pushing a stroller, etc., etc.

Ever hear that expression, "Can't walk and chew gum at the same time"? There you go.

I have come close to running over students at My Son's college because they are so absorbed in texting they don't have any idea what is going on around them. Maybe the first time a $250.00 fine and the second would be a $500.00 fine and the third could be $500.00 and loss of the phone.
The strange thing is it seems to only be the women that do this.
At least thats the way it is around here.

I wonder what the odds are that many of these people would still be alive to be fined a second or third time?
 
More laws that will be ignored, because the law really doesn't apply to them. Smart phones are smart enough to to be pre-programmed that only allows them to be used when stationary. Any movement shuts down the phone.
 
While ostensibly a public safety measure, the underlying issue is that reading, or writing, be it on a phone, tablet or paper based is a protected activity from government regulation. While there are time/content/place restrictions, famously yelling "Fire" in a crowded theater if there is no fire, these are generally subjected to quite a bit of scrutiny.

The criminalization of texting while walking would open of the questions of other distractions that ought be prohibited while crossing a street...talking....reading a paper...praying....blowing your nose....

Then there is the matter of what sort of attitude towards the courts, legal system, and police is fostered by chicken excrement regulations. After two weeks of slop and buggery in the local lock up, will someone be more of a product citizen or less of one?

"What you in here for?"
"Texting in a cross walk."
"Ooh, you a bad bad man..."
 
I hate to suggest than anything coming out of NewJersey's legislature is a good idea, but I'll make an exception for this proposal.

Sounds like a good idea.

Would make it kinda hard to call the cops while you're running, or use the phone while you're a passenger in a vehicle . . .

So my wife calls me from the grocery store (standing perfectly still of course) and asks me if we need spaghetti sauce. I'm in my office and get disconnected walking to the pantry?

Have you considered running for elected office? :D

My gosh! How can we make it another day without a new law to end this evil texting of which they speak. Off with their heads.:rolleyes:

So many laws on the books and we sure do need another one to put an end to this scourge. :eek:

Nothing is that important but a lot of people don't seem to realize that. Government regulations and laws cannot prevent people from doing dumb things. At some point survival of the fittest will always kick in. We have to many laws already no more please.

Amen.

And besides, there is a cottage industry on Youtube of walking texting incidents that would be crushed if stupid really could be legislated out of existence.:D

Our state government has ALL of NJ's problems solved. It's a Utopia over here except for those pesky texters.
