Thinking of supressing my 15-22

I have a 10 inch Contender in .221 FB. I bought it on a whim because the seller only wanted $20 for it. I did some groundhog shooting with it in texas years ago but haven't used it since.

You are correct, the muzzle blast, especially with WW680, is awesome, especially at night!
 
A good .22lr semi auto rifle with a silencer is hearing safe and very quiet. A bolt action is even more quiet.

300 aac blackout is quiet when 220 grain subs are used.

5.56 is pretty noisy, but most silencers will cut the noise about 30 db.

In Tennessee you can go to jail and may stand trial if you have a silencer (with the proper paperwork) and the cop/da are jerks. I am a firearms dealer and sot and will probably be indicted soon for having a silencer on my rifle.
 
kwikrnu, that's disturbing about the possibility of being indicted soon for having a legal silencer on your rifle.
In Oregon you can hunt anything with a can, we are limited to 5 rounds though.

Based on the fact that I am an 01 FFL/SOT and was arrested and charged for possession of a silencer on July 29, 2013. The NFA paperwork for the silencer was in the case that the rifle and silencer was in.

I am out on bail and awaiting the grand jury to indict me. I don't know when I will be indicted, but I will be and then it will be up to me to put on a defense for the crime of possessing a silencer. It is a class E felony.
I was in jail for hours, I am on unpaid administrative leave from my job as a registered nurse, and will likely have my FFL revoked as soon as I am indicted.

39-17-1302. Prohibited weapons.

(a) A person commits an offense who intentionally or knowingly possesses, manufactures, transports, repairs or sells:

(5) A firearm silencer;


As I stated the NFA form was with me at the time of the arrest. The magistrate was not interested in it. The judge at the preliminary hearing wasn't interested in it. The DA, who has had possession of the NFA document is not interested...

i believe a LARGE portion of your incident are missing...i'll be more clear...what law(s) is it being said that you have broken?
i would also add is that class 4 for the particular supressor in question?

I agree that you can be arrested and prosecuted, but not that you can go to jail for having a properly registered silencer. If you do, there is something seriously wrong in your state. Or you've left out a lot of details.

You left out the part of the law that will stop you from going to jail:

39-17-1302
(b) It is a defense to prosecution under this section that the person's conduct:
(7) Involved acquisition or possession of a sawed-off shotgun, sawed-off rifle, machine gun or firearm silencer that is validly registered to the person under federal law in the National Firearms Registration and Transfer Records. A person who acquires or possesses a firearm registered as required by this subdivision (b)(7) shall retain proof of registration.


The fact that they would pursue this at all is ridiculous. A wast e of time and money for the taxpayers, courts, and most importantly you. Whomever is responsible for moving this forward should face serious repercussions.

What your state needs is an update to the law such as this (we have this in Oregon):

"A peace officer may not arrest or charge a person for violating subsection (1) of this section if the person has in the person’s immediate possession documentation showing that the machine gun, short-barreled rifle, short-barreled shotgun or firearms silencer is registered as required under federal law."

With all due respect, it makes absolutely NO difference that you have the stamp and associated paperwork. Tennessee state law prohibits possession of a silencer, and that takes precedence over your stamp. Of course the DA and the judges aren't interested in your NFA documents.

I think you are out of luck with your case as you knowingly violated state law. Throw yourself on the mercy of the court and hope for the best, though it's your responsibility to know state law on NFA items ... Especially as an FFL holder.


Unfortunately, the way the law is written, he can be charged and prosecuted for the offense. But he should not be convicted of it if he did have the Form 3 with him. (Edit: originally said Form 4)

This is correct, except as posted the nfa document is form 3.

Tennessee law makes it a crime to possess a nfa weapon. The defense is proper papers. The proper papers may be presented in court as a defense once arrested, charged, indicted, and arraigned.

It is the same as carrying as handgun in Tennessee. The carrying of a loaded handgun is a crime. A defense is that the person has a handgun carry permit. You can be arrested, charged, indicted, arraigned, and later in court prove you had a defense.

A law like Oregon's would be nice, but people don't realize how backwards this state is in regards to weapons and laws in general.

The prosecution may prosecute this under the law

39-11-203. Defense.

(a) A defense to prosecution for an offense in this title is so labeled by the phrase: "It is a defense to prosecution under ... that ..."

(b) The state is not required to negate the existence of a defense in the charge alleging commission of the offense.

Dang i love Arizona! No CCW permit needed, no registration, legal suppressors, legal to hunt with cans, no round restriction (i use a 20 rd mag when hunting), except for migratory birds, shotgun limit 3 rounds (Federal) and 5 for hunting anything else. plus we can now hunt within city limits with shotguns and within the laws of normal hunting (1/4 mile from occupied dwelling, etc).

Love the land in TN, but your laws suck!
 
roadkill45, things like that make me want to move back to my hometown.
Tucson is just a little too close to the border. It used to be so nice to go hunt in the desert, now you have to have a buddy along.
 
well not really. i go all over the state predator hunting from the Rim down to Suarita right on the border. i have only had one incident with a run it with some invaders from the south and that was over some water, it ended well, they just had to split the extra bottle i had. i GPS mark where they are and call the BP.
the badlands are down by Nogales and the areas that they posted no entry to. IDK if those rules are still in effect or not. I'm on the other side of the state from Tucson but always take my gear when i go hit the VA there once a year.
great pred hunting down there and actually a LOT cooler than where i'm at now.
dove season starts tomorrow and i'll be out there in shorts and T shirt with a bird vest and Aussie hat. You will see the California guys out there with full camo on sweating their collective butts off thinking the bird can't see them.
i'll be out by 0600 and done by 0700 limit out. got the next two weeks off as my annual dove season vacation and my freezer will be overflowing by the 15th!
 
I am unaware of anyone checking at my club's range, either, and we have lots of club members and non-club shooters with NFA firearms and/or suppressors. Needless to say, the RO's don't check, either. It's not our responsibility.

I had a local privately owned range guy ask to see my paperwork on a couple of cans, a couple of years ago.

I showed him what he desired, but I have not been back to that particular range since; nor will I ever return.

Kinda feels like Christmas today. I called the BATFE today and found out my stamp was approved on 8-15... almost 7 months to the day from check cashed & 6 months to the day from pending.

Can't wait until my dealer notifies me. This will be my first experience ever of shooting suppressed & so looking forward to it. My home range is nearly completed and all 3 of my 22s now have threaded barrels.
