Gov. Andrew Cuomo took a "bit" of a hit in his approval rating since he rammed through his draconian "SAFE Act" gun legislation in NY. He has dropped 15 points or a whopping 22% in favorability (and they didn't even contact me for the poll).

He has been running a self-promoting commercial on TV nonstop touting his "other accomplishments" on-time budget, taxes, blah, blah, blah...for the last three weeks to regain some momentum. All on the tax-payer's dime of course.

His team appears to be in full blown crisis management mode because of this tailspin due to this ridiculous law and the shady (some may deem "illegal") manor it was enacted. I hope he got the message from we New Yorkers who value our individual rights and respect both the laws of NY and the US Constitution.

The full effect of Cuomo's anti-gun legislative wrath will not be felt until hunting seasons start. What NY's elitist antis don't realize is that there's a lot more to NY than the Albany-NYC beltway. And when 10s of 1,000s of hunters are forced to have background checks called in to buy boxes of hunting ammo, a logistical nightmare will come crashing down upon the state. The worst part is that many Mon&Pop gun stores are going to be forced out of business simply because they cannot comply with the "laws" ...

When the law passed it was written that the governor's motivation was a future run for the white house. That seemed odd to me because gun rights is not a complete conservative cause. There are some liberals who are for gun rights. The NRA declined to fight the Clinton gun ban because the court was not surely pro 2nd amendment. Today it is. If the makeup of the Supreme Court doesn't change soon, I predict that the NRA will challenge this in court. Should it be overturned the bad smell will be attached to the governor for a while and to the Republican lawmakers who went along.

mc5aw,
I think that the part of the bill that requires a check for buying ammo will be a fiasco. There has been no guidance as to who will be setting it up, no finances specified for the start up cost etc.. This whole legislation was not thought out at all and it's really showing at the local meetings they, the NY State Police, have been giving at different localities across the state.
As has been mentioned Cuomo's numbers are in a free fall and it's really put a spotlight on how premature this legislation was and how zealous some of our lawmakers can be. Even the CT. lawmakers, where Newtown is located , have critisized NY lawmakers for rushing into this too quickly.
I'm hoping this legislation will be overturned and Cuomo will look worst than he already does! Please pray for us New Yorkers.

Thanks,
Len

Politico has a story on a survey from Siena Research Institute....

65 percent of of those surveyed SUPPORT the new ban.

N.Y. poll: 65 percent back gun law - Katie Glueck - POLITICO.com

Assuming that the polling methodology was sound and the results are accurate, how long do you think that those 65% will continue supporting this law when it comes time to arrest, prosecute, and incarcerate even a small percentage of the rest of us?

Does anyone know of a court system that has enough judges, clerical staff, prosecutors, etc, to handle the caseload right now? How about a county sheriff with enough bed space to meet current demand?

Last estimate that I heard indicated that there are about 1,000,000 semi-auto firearms in New York that have been made illegal under this new law, not to mention all of the magazines capable of holding more than 7 rounds of ammunition. If even a small percentage of those New Yorkers refuse to register, refuse to surrender, refuse to post bail, enter not guilty pleas, and demand jury trials the entire legal system of the State of New York will grind to a halt within a matter of weeks. Judges, sheriffs, and administrators will be begging the political hacks in Albany to repeal this stupid law.

The key to overcoming this ridiculous political act will be active peaceful civil disobedience. New Yorkers should now be organizing in groups, each having an attorney on retainer ready to flood the court system with every known defense tactic to make it as difficult and expensive as possible for the State to continue with any actions against those who refuse to buckle under to tyranny and Constitutional outrage.

The New York Constitution contains specific language to the effect that the right of the people to keep and bear arms "cannot be infringed". Every single attempt to enforce this law should result in a civil action for violations of citizens' rights, further inundating the New York courts.

Public opinion will change pretty quickly when folks start seeing their property taxes, sales taxes, personal property taxes, etc (already among the highest in the nation) start going through the roof to support the State in prosecuting these newly-manufactured "criminals" and defending against thousands of lawsuits for infringements of Constitutional rights.

It won't be easy, and it won't happen quickly, but this is the best possible response to the government's arrogant and ill-advised actions.

The title of this thread "The people hath spoken" seems to indicate that majority rule is the law of the land. Far from it! We do not live in a democracy, we live in a constitutional republic with democratic institutions, with government constrained and limited by constitutional guarantees of individual liberty.

The New York Constitution states that the right of the people to keep and bear arms "cannot be infringed". This is a very clear limit upon the powers of government, and a very clear guarantee of individual liberty.

Constitutions (federal and state) do not grant rights, they exist to enumerate and guarantee the rights of the people.

Mr. Jefferson specifically warned us about democracy, which he described as "the tyranny of the majority".

This little exercise by the state government of New York serves as an excellent object lesson, clearly demonstrating what the Founding Fathers were attempting to prevent with a Constitution and Bill of Rights.

So what happens when a NY citizen makes a trip to PA and brings back a box of ammo? Does he have to immediately register it with his county sheriff? Does he become a felon by the act? And what happens to someone traveling through NY with "banned" weapons, magazines and/or unregistered ammo?

I don't know about the first part of your question but in answer to the last part of it, I believe you would suddenly be wearing steel bracelets!

Not that I believe any polls but even more disturbing, according to one, is that 40% of gun owners in NY still "approve" of King Cuomo. We have met the enemy and he is us.:(
That may change come the fall when grandpa takes out his 30 aught to go hunting and finds himself waiting in line for a NICS check on his one-a-year box of ammo. What happens if he gets "delayed" just before the season opener?

1- nothing unless there's a trooper at the border ;)
2- only if he feels the need ;)
3- if he does either 1 or 2 and tells about it ;)
4- depends on who you run into

Very true. Karl Rove and a couple of other guys stumbled on this truth back in November while they were working the other side of the street.

Remember the statistician's rule: If you torture your data long enough, it will eventually tell you what you want to hear.

"what happens to someone traveling through NY with "banned" weapons, magazines and/or unregistered ammo?"

IIRC...There is a Federal law that allows / permits the transport of firearms interstate...As long as they are cased / stored / transported in accordance with that law... Comments welcome..I can't find the statute???

There are three kind of lies, "Lies, damned lies, and statistics"

I would like to see a poll on what people think of polls.

From what I understand, NYS has set the record for the largest civil disobedience in US history. There have already been several law suits filed and I would not be surprised if this entire bill goes south and will have to be re-negotiated. So far even Law Enforcement has become criminals under this law.

IMO, the voters are the issue. If the politicians with anti-2A views keep getting re-elected. . .well, you are not going to fix it with all our letters & rallies. Election day does more than anything else to decide the issue.
