Oh lord. I'd be put away for life! I must have 2k casings in my trunk haha

Sent from my XT907 using Tapatalk 2

I was cleaning my truck out last night. Found 12GA, 22LR, 9mm, and 45 ACP casings under my bed mat. .223 brass had dumped over at some point and was all over the front and back passenger side. And I had two Walmart sacks of range brass behind the drivers seat.

I would have been put away for life!

Been that way in the Commiewealth of MA for some time.

I remember back in the early 60's my family went on a summer trip to Washington D.C. We visited the FBI Headquarters for a guided tour, which was given at that time. At the end of the tour an FBI agent performed a shooting exhibition with a Thompson machine gun. He fired a full clip into a target at their indoor range. All the participants in the tour viewed this from behind a glass partition.

After the smoke cleared the agent passed out all the spent brass casings to the little kids like they were candy. No big fuss, no screaming mothers. I kept mine for years tucked in my dresser drawer. Got misplaced when I went into the Marines in the 70's.

Gone from passing them out to little kids to now being a criminal. I don't know what has happened to our Country.

The question is, are people getting prosecuted for it. The US Attorney's office handles local crime prosecution as well as federal prosecutions. I find it hard to believe that the US Attorney would spend time prosecuting people for empty ammo casings. As hideous as it is to arrest someone for empty casings, if arrests are made I would expect them to be "no papered" by the USAO and never make it to Superior Court.

That's not to say it would be fun to be locked up and possibly spend the night in a DC jail before being nollie prosecuted. I've been in DC jail and its not a nice place.

I'm afraid I don't hold much stock in what that article said.

1. It was written by a woman "Emily Miller" for her "Book"

2. Police are under "Orders" doesn't have wings and can't fly..

Orders are not the law.

Someone show me the "Law" as it is written and then I will retract my statements.

§ 7-2501.01.
Definitions
(2) "Ammunition" means cartridge cases, shells, projectiles (including shot), primers, bullets (including restricted pistol bullets), propellant powder, or other devices or materials designed, redesigned, or intended for use in a firearm or destructive device.

§ 7-2506.01. Persons Permitted to Possess Ammunition
(a) No person shall possess ammunition in the District of Columbia unless:
(1) He is a licensed dealer pursuant to subchapter IV of this unit;
(2) He is an officer, agent, or employee of the District of Columbia or the United States of America, on
duty and acting within the scope of his duties when possessing such ammunition;
(3) He is the holder of a valid registration certificate for a firearm pursuant to subchapter II of this
chapter; except, that no such person shall possess restricted pistol bullets;
(4) He holds an ammunition collector's certificate on September 24, 1976; or
(5) He temporarily possesses ammunition while participating in a firearms training and safety class
conducted by a firearms instructor.

If you have an empty/fired cartridge case, bullets not loaded in a case, primers, powder etc in your vehicle that is not stored so it can’t be accessed by the driver or any passenger you are in violation of DC Code and can be fined and jailed.

Xtasy,
Thanks for the info. Pretty close to the wordage here in MA. Any component of a bullet is considered ammunition. We don't have that "restricted pistol ammo" clause. I'm sure that is Black Talons or some other "dangerous" round or something with a scary name.

Retirement is coming and I plan on moving. Problem is this nonsense seems to be spreading to all corners of our country.

Regards

Can I come out of my room now?

WuzzFuzz,
ANY firearms violation here in MA is an automatic 1 year sentence. No bargaining or deals made. If a subsequent violation, the penalty increases depending on the infraction. I think the next step up is automatic 5 years. Applied to perps is one thing but an honest mistake (piece of old brass in car)by a vacationer is a scary thing. Texas is looking better every minute.:)

Klyde,

You're driving me nuts....I've went back thru those DC codes...From Code 22 criminal code...Codes 24 sentencing, and these under Code 7.

In the Code 22 the Criminal codes, then there is the reference back to Code 7. The Codes in Code 7, are what I used to refer to as MUST HAVES....There is a requirement to have XYX...but no penalty for not having a XYZ.....Not having a XYZ is covered under Codes of 22......If no penalty is listed in Code 22, then reference is to the Codes of 24 Sentencing....If not found there, then there is still another chapter dealing with Max and Min of Felony or Misdemeanor or with juveniles and probation.

GRRRRRR....I'm glad I'm out of it all...or I should say got out before the place went nuts.....

Without making for another discussion for another day....It seems to me that the further west a person goes..... the more that common sense prevails....Glad I'm sort of located where the West begins..... just about anything west of the Missouri river.
