First gun confiscation in NY

Seems the state police were given orders to remove any and all guns from our rally yesterday.:(

Some really deadly wooden AR's were confiscated. :rolleyes:

That wasn't the case at last year's rally! I figured 10,000 people at least half had cc guns on them then.

Were there snipers and troopers on the adjacent building roofs as it appeared there were last year????
 
Apparently the First Amendment does not mean any more than the Second. Under what authority did the State confiscate his replica gun? A sign?????? How was that plastic gun anything less that a photo or a sign. I believe they stole his property, suppressed his right of speech, and generally violated his rights under color of law. He should sue in US district Court for a violation of his Civil Rights.
 
They moved the rally a couple hundred yards away from the last two, I heard the state got tired of replacing the lawn. ;)
I didn't see any snipers, but maybe they saw me. :eek:

There's a lawyer already looking into it, under exactly those grounds. This appears to be headed to court.

Oh, I forgot, the signs were put up 30 minutes AFTER the rally started.

Yep, a lawyer is already on the case.

"For those of you who don't already know, yesterday at the Albany anti-Safe Act rally on Empire State Plaza, a protester dressed in colonial attire had his Airsoft AR-15 toy gun and a plywood AR-15 cut out with the Second Amendment written on it seized by uniformed NYS Troopers. The citizen did not resist, and they confiscated both items. This is actually the same protester who also had the life-size doll Cuomo effigy on puppet strings and he was actually giving a trial of Cuomo in front of other protesters and was spanking Cuomo's effigy with the plywood cut-out and it is as he was spanking that the Troopers came over and the incident began.

I just spoke with Mr. Sxxxx. I have his case. He has authorized me to make a statement. He is a fine American and agrees his rights were trampled yesterday. He is a former Army helicopter pilot. He served in the Gulf War and is also the holder of two US patents. He is an engineer. I am now investigating the case. I need everyone with any potential evidence to contact me and send me a copy of the video or photos. I need all photos of the signs that were posted at the rally site that banned any items, including all signs banning toy or replica guns, all video and photos of the incident from the time the State Police first started to interact with him until they all left the area and even before and afterward film of Mr. XXXX demonstrations. He also stated that once the NYSP saw the Cuomo puppet, they moved him to a corner and blocked access from a section. This is very troubling and it appears that a deliberate effort was made to stifle his speech. Anyone who spoke to anyone involved, including the Troopers or the witnesses and especially if you personally witnessed the incident itself, I need to speak to them ASAP. Please send me a PM and I'll get back to you."
 
Very disturbing to see our Constitutional rights being violated with such arrogance and impunity by government representatives...very disturbing.

42 U.S. Code § 1983 - Civil action for deprivation of rights

Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia,subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress, except that in any action brought against a judicial officer for an act or omission taken in such officer's judicial capacity, injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable. For the purposes of this section, any Act of Congress applicable exclusively to the District of Columbia shall be considered to be a statute of the District of Columbia.​
 
To add, the lawyer who is taking this case, was already at the rally at the time this incident took place. He was notified late yesterday of the confrontation and immediately reached out to the patriotic American who rights were trampled on.
 
Unfortunately, the Judicial branch of government has become nearly as corrupt as the Executive and Legislative branches have become, so it appears it will be an uphill fight to retain our Constitutional rights in the foreseeable future. :(
 
The State could have posted one million signs banning replicas, yet they had no right to do so. What argument could the State make. Oh yeah, I know..."We would be unable to discern the difference between real and replica and a tragic mistake could take place causing necessary injury"

Well that is my take on what they will say, and those Troopers.. They will tell you they were only following orders. We can hold their trial in Nuremberg!!!!!

It's ridiculous that police take an oath to defend the Constitution, because in the end, for perhaps 98% of them, following orders so as to keep their jobs and get closer to a pension will trump whatever doubts exist in their minds about the constitutionality of any order they're given.

It seems to be true for 100% of the NY State police who were assigned to "monitor" the rally in Albany and followed orders to prohibit even toy guns used for demonstration purposes. Wouldn't you say we seem to be pretty near having the government the framers of the Constitution were fearful of when that type of control is exerted over the people? Watch the youtube video the OP posted in case you haven't.

We have a distorted view of things when seeing them from inside this type of forum. I say that because even with our differences, we are all like minded people. Otherwise we wouldn't be here. Because we are all hard core 2A supporters, it's easy to lose site that the vast majority don't have the same mindset.

Most go to work because they have to. A small percentage really love their jobs and do it just for that. Even so, all of them are trying to provide for their families. Therefore, they are going to do what the job requires. This means they aren't thinking of lofty ideals of protecting 2A or 1A rights. They are simply thinking of earning a day's wage and going home to dinner. As such, they do what their superiors tell them.

Being able to work tomorrow often holds more power than the ideals in the constitution. So, when an average Joe is told to go do something, he isn't thinking about whether or not that order is legal, he just wants to keep his job.

This is what we're up against more than anything else.
