Gun Store Owner Wins Big against County

Martin Tretola, proprietor of T&T Gunnery, Seaford NY, has won a $5,000.000 settlement in federal court against Nassau County NY.
The DA for the county is Kathleen Rice, an anti-gun crusader.

Tretola was arrested and charged with "operating a range" in his basement, adjacent to a natural gas line. The subsequent charges left him out of business for over a year. Charges were later dropped when the "range" turned out to be a bullet trap and the natural gas line had been disconnected and out of service years earlier.

One would think that investigating authorities would get their facts straight before attempting to run someone out of business. While the verdict is on appeal, the county will ultimately have to fork over some cash while the bureaucrats responsible for shoddy investigative work will all receive promotions.

Score one for the good guys. I'm a customer of T&T Gunnery and it is one of the better equipped gun stores we have in these parts.

I read $5,000 and thought to myself "that's not worth being out of business for a year!", then saw the news article.

A comma makes a BIG difference ! :D

Also was not a settlement, was a jury verdict, and thus may be appealed.
 
It's too bad politicians and bureaucrats don't have to personally pay a penalty as severe as what they inflicted on their prey when their actions are ruled illegal or unconstitutional. If they did; it would change a whole lot of political behavior in this country. But as usual, the guilty politicians and bureaucrats will pay no price but innocent taxpayers will take it in the shorts.
 
Lets hope so...However law suits against a government agency can and do take years getting trough the appellate courts..Remember the government is spending your money on appeal after appeal...in effect your taxes are being spent litigating against you...I know of a case.... when a government employee won not only the case on merits but also was awarded the cap for punitive damages. the employee went bankrupt long before the case was to be heard on the second appeal by the state....
 
If I were him and was paidoff-id simply leave that State and re-open elsewhere thumbing my nose at that (you fill in the blank)

Mr. Tretola should go to the county commissioners and say hey would settle with them. All he needs is: 1) about $60,000 for each month he was out of business. 2) be allowed to run his business in normal and non-retaliatory manor, and 3) Ms Rice must resign her office and leave the county for no less than 5 years or until Mr. Tretola retires!

I bet the county commissioners would go for it if they save a few million bucks! Lets see what an anti 2nd ammendment office holder will do with that ! Ivan

Your information (old) WAS correct initially. Last week, the County of Nassau appealed the settlement amount and they whittled his settlement down to a measly 1.3 million. It really is measly considering how much it cost him in legal fees, loss of business and damages to his firearms, not to mention the embarrassment of being arrested in his own store for doing nothing wrong. The whole thing was a set up by the DA looking for popularity because she wants to run for the Senate!

If I were him I'd appeal the appeal if that's possible. In that County the deck is already stacked and the DA is NOT a fair person (trying to not get dinged here). Very sad situation but not withstanding the amount of money at least it was a win for our side.

Wasn't T&T involved, along with other shops on LI, in the illegal actions by Rice a few years back, when they arrested the shop owners for "illegal" AR sales?
What became of that?
