So, should she plead "guilty"? Read the state definition of "disorderly conduct" I posted at the end. It speaks a lot about "intent" and being "engaged in."

New Charge Against Woman Who Allegedly Left Gun In Church

Waukesha – Prosecutors on Tuesday filed a new charge against a woman who allegedly left a loaded gun inside a bathroom at Elmbrook Church in Brookfield (WI) last March.

Susan Hitchler, 67, of Oconomowoc (WI) was charged then with endangering safety by use of a dangerous weapon after a criminal complaint alleged a loaded semiautomatic handgun was left in a woman's (SIC) bathroom at Elmbrook Church on March 19.

But the charge against Hitchler was dismissed when the defense argued that no one's safety was materially endangered in the incident.

In Tuesday, the state filed a new charge of disorderly conduct, punishable by a maximum fine of $1,000, 90 days in jail or both upon conviction.

According to the complaint, a church employee found the gun and came out of the restroom with it, asking a facility manager, "Is this real?" The Ruger .380 gun was loaded, had a round in the chamber and no safety switch, meaning anyone who may have found it and pulled the trigger would have discharged it.

At the time, an adult women's Bible study was going on, which allows women to bring their children with them; the bathroom was accessible to girls in the church at the time, the complaint said.

It added that Hitchler called the church looking for her firearm, believing she may have left it there. Hitchler told police she took the gun off clip on her waistband and set it down and forgot about it, the complaint said. About a half-hour later, she realized it was missing.

The complaint added Hitchler "was upset and indicted she could not believe she had done this."

Hitchler is due on court Dec. 8.

Elements of the charge of disorderly conduct under Wisconsin criminal laws:
Disorderly conduct is a Class B misdemeanor
DISORDERLY CONDUCT
Defendant engaged in violent, abusive, indecent, profane, boisterous, unreasonably loud, or otherwise disorderly conduct

The conduct of the defendant, under the circumstances as they then existed, tended to cause or provoke a disturbance

Maximum penalty – 90 days jail and $1,000 fine

Note:
disorderly conduct is prohibited conduct for CCW in Wisconsin.
From the WI DOJ website:
"Prohibited Conduct For Anyone Possessing a Weapon
The CCW statutes do not, except where noted elsewhere, change any other existing laws governing the conduct of individuals and the use of weapons. For example, the following conduct is still prohibited:
Disorderly conduct. Where the facts and circumstances indicate a malicious or illegal intent a person may be prosecuted for loading, carrying, or going armed with a firearm. Wis. Stat. 947.01(1) and (2)"

I don't know what they can charge her with, but leaving a loaded gun in a public place where kids can find it is a very serious mistake IMO.

They should pull her permit.

Yep. Ditto for all the cops and other LEO's who have done the same thing. They should hand in their badge and be fired immediately.

While it's a terrible mistake, it's more common than most people think for everybody carrying-cops included. Most locals recognize this for what it is-a vendetta similar to the unending one the Milwaukee Urinal has been waging against Badger Guns & the shop's succesors IMO.

Off topic, but:
Bruce M, you are right on about Badger Guns.

I was an occasional customer at Badger guns when they were still selling guns. They got blamed for a "large" number of guns used in crimes having come from their business, without adequately noting that they were the last gun store IN Milwaukee.

After the Milwacky Urinal's first series of attacks on them I happened to be in the store. I was looking at the holster rack next to the office door. I heard the owner on the phone. He was talking to the BATF (before "E") saying he believed a couple at the counter were conducting a straw purchase. He said "All right" into the phone and hung up. I looked at the couple at the counter and said "You think that's a 'straw purchase? What do they (BATF) want you to do?"
He answered "Make the sale. They said that way they know who owns the gun."
YIKES! So the MJS turns around a blames Badger for such sales.
Second time I saw a couple at the counter and the man was hanging over the woman's shoulder as she was looking at a gun taken out of the display case. Both had odd grins on their faces. The clerk repeatedly asked the woman "You're SURE this is for you?" "Now, this gun is for YOU, right?" "You can't buy a gun for someone else." That last with a long look at the man hanging over her shoulder.

To me, here is the kicker: both couples were black. What if a car dealer kept asking a black customer if the car was for him/her? Or a liquor store owner? How long would it take for the civil lawsuit to follow? Yet, Badger was reamed out by the MJS for making legal sales to black people.

Hmmmm, so the Captain who left his gun in the stall at the PD for me to find should have never become Chief. The fact that he lied about how long it took him to figure out he was missing his weapon aside, he should have been fired...I could go for that in his case.

She made an error but unless DC has changed a whole lot since I left WI LE, it ain't disorderly conduct. I don't have a concealed carry permit so I don't know what the rules are but if she violated the rules, lose the permit. If not, move on. The Waukesha County DA was just elected WI AG so this does not bode well for my opinion of him. But his opponent was a Hack...or was it Happ. :p

Wait a minute here folks...
Any idiot that leaves a gun behind needs to be charged like this then. You police types too. Fair is fair...

Bury them all under the jail. How hard is it to recognize that a firearm is a deadly weapon and when negligently abandoned in a restroom should be an offense that a person is held criminally responsible. Call it felonious ignorance or something similar. If a citizen screws up and gets charged then it follows the next LEO who does the same thing suffers the same fate....
 
One of the key elements of a crime is intent. Obviously, there was no criminal intent in this case. With all of the televised looting and rioting that has become an acceptable form of protest now, how could anyone charge this lady?

Lets face the facts here, they want the money, and the news story of guns are bad, no one but the government should have them.
 
The lady made an honest mistake, no malicious intentions... something bad could have happened... but it didn't.

People say she should have her CCW yanked... ok, then by that same reasoning, anyone that has ever had an accidental discharge happen (and no one was injured), should have their firearms confiscated and charged with the illegal discharge of a firearm.

No learning their lesson and being given a second chance... just sorry, you blew it Charlie... no more gun rights and here's a criminal record to follow you around for the rest of your life.

Or how about a hand loader that experiences a Kaboom because they unknowingly double charged a case.

The flying shrapnel could have seriously injured or even killed someone on the range... why not criminally charge the hand loader with public endangerment, take away their gun rights because they have clearly demonstrated that they can no longer be trusted.

Now doesn't the above sound a bit ridiculous?

It should, it's along the same lines as some of the no common sense, zero tolerance, actions that some school districts have recently handed out that leave people shaking their heads in disbelief.

She shouldn't get a pass either... suspend the CCW for period of time and levy a fine, I bet she won't make the same mistake again.

This is the reason I never carry off body, because of the risk of
such an incident. I also think as I use the bath room, "gun, gun, gun, gun, gun, gun, gun, gun, gun while in the bathroom
and if I have two on, I am not going anywhere without both of
them. However, many folks have made such a mistake and
I would hate to see her punished severely. If the justice system
did its job, and did not recycle so many criminals, she would not
feel the need to carry in Church.
 
What she did was a mess----but----good people make mistakes-

The LE and DA's of this country need to quit trying to make criminals out of good people.

The prosecutors need to find something better to do.

There have been similar incidents, some right here on this forum have been posted where law enforcement officers have
made the same mistake. I expect they are still in law enforcement.
 
I'm sensitive to this issue because my church has a lot of little kids running around including mine. I'm going to get flamed for saying this, but I believe that responsible CCW holders need to be held to higher standards. While she may not of had any criminal intent, she screwed up. Royally. You get into an accident with your car, your held accountable. Get into enough accidents, you loose your license. She's very lucky some little kid didn't find the gun.

Carrying a gun is a tremendous responsibility. The consequence of screwing up this responsibility can be fatal and tragic.
 
I think a reasonable suspension with a fine is warranted, but there is probably no oversight jurisdiction that can levy that. That leaves only criminal prosecution on the table.
