"SAN FRANCISCO – The Mexican man acquitted of murder in the shooting death of a San Francisco woman that sparked a national immigration debate is seeking a new trial for his conviction on illegal gun possession.
Lawyers for Jose Ines Garcia Zarate said Thursday that the judge presiding over the murder trial failed to properly instruct jurors before they acquitted him of killing Kate Steinle in 2015.
The lawyers argued in court papers that the jury should have considered his claim that he didn't know he was holding a gun when it fired.
They say Garcia Zarate didn't hold the gun long enough to warrant a firearm possession conviction.
The judge declined to include those instructions, and jurors convicted him of being a felon in possession of a firearm."

What is the exact time limit of holding and FIRING a gun to define "possession"??:eek:

I was in the George AFB Avionics Shop conferring with my assigned Maintenance Officer, Richard 'Dickie' Dees.
Suddenly Dickie leans in and says, there he goes, it's him!
He was talking about a civilian guy who walked past.
This dude was acccused of killing his girlfriend.
He burned her while she was still alive as her little daughter watched.
This guy went to trial but got off with some legal flim-flam just like in the OP.
Since he is 'innocent' he still had his AF Civil Service Position.

The BIGGER question is this: Why is a "non-citizen" being afforded the right to a trial? And at OUR expense no less!
I completely agree with you. However, in this case, it might have been better to have the trial. The other option was to simply deport him. He'd already been deported 5 previous times. So, that option obviously wasn't working.
 
Just another example that proves the old adage that "Truth is stranger than fiction."

Who would've ever thought something like this could ever happen? It seems like things are "going to heck in a handbasket"...and darn quick, too.

Obviously, it was all the victim's fault. If she hadn't been born here in this country and then felt entitled enough to take a walk outside in a public space by the pier that day she would never have been killed and caused all these problems for the less privileged by disrupting the status quo of sanctuary cities. Shameful. :rolleyes:
 
The real problem here is that this pistol belonged to a FEDERAL LEO!
This Officer either left it exposed on the rear seat of his plain clothesed official sedan, or it has also been said that even that this Sig-Sauer pistol may have been on the street close to the sedan's rear door.
This is where this ILLEGAL ALIEN said he found it.
My personal belief is that the perp saw the weapon laying on the backseat of this vehicle.
I do NOT believe at all that this Mexican illegal did not know what he saw and took.
I believe that he knew it was a pistol, and picked it up,or actually stole it from the un-locked sedan.
Then, this convicted perp sat down on the bench and was "handling and fondling" it when he pulled the trigger and shot the woman sitting on another bench across from him.
The trial is now over. Justice has been Adjudicated, San Francisco Style.
However,,, I have not heard what was done with the Federal LEO who actually owned this pistol? Please respond if you actually know....

You won't hear what happened to this BLM agent unless he is charged criminally. Any personnel action will be deemed private.

The usual in-house procedure is an investigation by the agency's version of Internal Affairs. This agent worked for the Bureau of Land Management, so they could do it. It could also be investigated by the Dept of the Interior's Office of the Inspector General (OIG).

The charge would failure to secure government property (even if it is a privately owned weapon, which I don't think it is.). The usual penalty is a bad-boy letter and some time without pay. In this case since the gun was later used in a homicide I'm sure they could fire him. If he has enough time in he could beat them to the punch by retiring. Or he could just resign and avoid the stigma of a dismissal.

He could also be charged by the local jurisdiction if leaving a gun unsecured is a crime. BLM will almost certainly not go to bat for him given the circumstances.

Or, as alleged below, he could get promoted. According to this, the gun was in his personal car while he moved with his family from a duty assignment in El Centro, CA, to a new position in Helena, MT. Since it was his POV, the BLM determined their poorly-written rules didn't apply.
