FBI NICS says background check numbers are up!
After hearing the dealer I usually visit crying the blues...
I read that according to NICS that background checks for firearms were up over this time last year by a couple of percent.
I wonder if this is happening where people are retrieving their pawned firearms?
This just seems unbelievable to me, as last year was the "frenzy."

Sorry to get a little off topic with this question, but...are there any states that do not require a background check if you have a CWP?
I live in FL and according to this one dealer when I questioned it, he said even LE has to go thru the process. They could walk in wearing their uniform with their Glock strapped to their side, and they still have to be checked out.
Any truth to this?

More people are buying new guns. More kids have gotten to the age where they can buy guns.
It is old news that Americans are buying guns in record numbers, even with the economy being as the media portrays. I personally do not think the economy is that bad. People seem to have the money to do as they wish. Many are spending money on high ticket firearms.

I usually buy used, and mostly from private individuals, but I filled out the dreaded form a few days ago. Just doin' my part to keep the FeeBees busy.

In Arkansas a CCW permit gets you a pass on the check.

A Georgia permit gets you out of the background check.
For a short while there, it did not- as some fed figured out that some way the state did the background check it didn't meet the criteria.
I remember that was the biggest part about getting the permit.
If you are a Georgia resident, get it renewed quick, as they are going to a "smart" license and wasting major tax $$$$ doing it.

NC does not use the feds for handguns.
Handguns can use either a CCW or a "handgun purchase permit" issued my the local sheriff's dept.
Long guns can go through the fed's (sometimes)-insta-check or they can use the CCW or the "handgun purchase permit".
Unless SC has changed, they handled all of the insta-checks instead of the feds.

Well, I wouldn't get too thrilled that your state CHL lets you skip the Fed insta-check on each purchase. Just means your state is keeping your background check up to date enough to satisfy Fed requirements.

ATF says that dealers licenses are way down, which means there are more people buying guns and less selling them, I guess. Which begs me to ask why my C&R is taking so long...lol

No check in Utah if you have a Utah concealed weapon permit. Incidentally, last I checked, Utah the nation's most popular state from which to obtain a CCW permit because you don't have to be a resident and it will accept CCW training in other states that meets Utah standards. At last check, Utah CCW permits were recognized in 38 other states!

In Texas if you have a CHL [Concealed Handgun License] you do not have to go through the instant check.
There is no waiting period here either.
As it was explained to me,
Law Enforcement still has to go through the check, unless your Police ID is less than 5 years old.
But I do not have any specific incidents, where some one had used a LEO ID that was less than 5 years old to bypass the Instant Check.

I'm sorry sir.. but EVERY 4473 in FLORIDA gets a NICS check.. All the CC permit does is allow you to by pass the 3 day wait.. CWP . pass the NICS check and you take it with you.. No CWP still have to pass the NICS check.. but you wait three business days to pick up..

The dealer does not charge for the FLDE ( NICS) check, they collect it.. at the end of the month the FDLE sends a bill based on the number of " calls" to assign the "NICS" number.. and that bill must be paid.. and that's where your $5.00 goes..
Nobody's been stealing from you my friend.
In 1989 Florida passed a law requiring an FDLE check PRIOR to any sale.. The purpose of the law was to do a state wide and national criminal check before an approval for purchase was given.( Exemption is of course private sales to an individual ).
I hope this helps..

Louisiana: no check with a CCW permit. Without permit, check is free and 3 day wait only if "delayed" by FBI.

Thanks for setting everything straight. And I am aware that the dealers are collecting and not charging. It's just that when I was lead to believe that there wasn't supposed to be a charge for CWP holders, the conclusion was that the dealers were pocketing the money on all the new permit holders that have been bursting thru the doors of the gun shops these past 2 years.
If this is a federal thing, then why does each state have its own set of laws concerning the federal instant background check?

The states can have their own laws, it is the feds who decide if the state's laws are "good enough" to bypass the fed check.
As I stated for NC.....
The feds don't require their own check for handgun purchases because either the NC CCW or the handgun purchase permit issued by a sheriff are good enough for the feds.
Kalifornia makes people wait 15 days, which is well beyond any wait the federal check would be on a delay.

No licensed gun dealer, manufacturer or importer shall sell or deliver any firearm to another person until he has obtained a completed form from the potential buyer or transferee and received approval from the Department of Law Enforcement by means of a toll-free telephone call.
The Department of Law Enforcement shall destroy records of approval and non-approval within 48 hours after its response.
***********************************************************
"Exempt from the instant check are licensed dealers, manufacturers, importers, collectors," persons with a concealed carrying license", law enforcement, correctional and correctional probation officers.
Excluding weekends and legal holidays, there is a three-day waiting period to purchase a handgun from a retail establishment. Exempt from the waiting period are concealed weapons permit holders and those trading in another handgun.
Yes the form still must be filled out though!

Hello! can someone please let me in on what the real truth is?
Every time I purchase a gun there is always a delay on my call-in and I have drive all the way home, only to get the phone call an hour later telling me it's ok, and then I have to drive all the way back the next day to pick it up.
Someone with a CWP shouldn't have to go thru this....

I need a lawyer....
Turns out I'm gonna have to let a lawyer take a look at the statute.
It doesn't exactly say I'm "exempt" from having to have the call-in done.
At the bottom there is this:
"However, if the person buying the firearm is a holder of a valid CW or Firearms License, the provisions of this subsection do not apply."
The problem is, it's not clear as to what "subsection" they are referring to.

Yeah that's what James and I were discussing.. I am going to try to get to the bottom of this.. The attorney to get to is Jon H. Gutmacher.. noted firearms attorney and author of
Florida Firearms Law Use & Ownership.
