By definition it is still accidental even if it was caused by negligence. Unless the intent was to discharge the gun it was accidental. Negligent as well but still accidental.
Then I would use whatever I shot the best. If you can put it where it needs to go you're 9mm or .38spl will do the job. I shoot my .357SIG the most so that's what I would use. I'm also very confident in the round if I put it where it needs to go. Use whatever gives you that confidence.

Also, if you are "well trained for this type of situation and can place my shot" then it doesn't matter what you carry as long as it is the gun and load with which you train.
I have both HKS and Safariland and I very much prefer the Safariland. I am a whole lot faster with the Safariland than I am with the HKS and they just "feel better".
That is my idea of the perfect gun. It has all the features I like, fixed sights and shrouded ejector rod. They just look tough as hell. Wish I could afford one.
Dammit! Does anyone make one that is an easy swap for the older guns? Even if I drilled and tapped the frame would there still be a gap between the rounded sight leaf and the square channel on the frame?
