S&W Model 17 Not ALLOWED IN CA.?

I sold my S&W Model 17 22LR on Gun Broker. The buyer says he does not want the gun BECAUSE it was made by Bangor Punta and IS NOT a S&W. He also says the gun is not allowed to be sent into CA. to a FFL because it is illegal. I'm in Texas and was about to send from an FFL. There was an $1100.00 bid on the gun and he did a buy it now for $1500.00 ANY suggestions or remarks would be appreciated. Serial 78K9843.
 
Bangor Punta was the corporate owner of Smith and Wesson NOT the manufacturer, your M17 clearly is marked as a Smith and Wesson.

Sounds like your buyer is trying to back out of his purchase to me.

I don't know a thing about California DOJ approved firearms roster...Collects seems to up to speed however....follow his advice.

Kalifonian here, haven't heard of the double action sear trick, I will be exploring!!

Here's the deal. If it is not on the doj list (linked above by Wrangler5) exactly by dash # it cannot be transfered legally by the FFL. Buyer should have known this!! But, the FFL is correct in this case.

If the gun is 50 years old you can get around this and transfer as a C&R. But, since Bangor didnt take over till 1965 I'd assume he's not that lucky...

I know when ever I sell a gun I won't even consider Kalifonia, Main or NY. Bad MOJO in those states.
 
I'm in California (not Kalifornia please) It's sad but true about the M17 not being legal in Ca. if it's not 50 years old or a Single Action Exemption. Yours looks like very early 1980's. M17-2 was around 1964 so they may qualify. They are legal in Ca if they are being sold in Ca by someone living in Ca. to someone living in Ca. FTF at a Gun Store. Am I correct that you are the seller and the buyer is in Ca? If so, I would say just put it back on GB and mention no California sales. You may not get the buy it now price but you should get a decent price. The Bangor Punta excuse is lame but it's not legal in Ca because it's not 50 years old or a SAE. Hope this makes sense. I have purchased a S&W K-38 and K-22 on GB and had it shipped FFL to FFL with no issues as they were dated 1953-1954. Sorry for your situation. Luckily you weren't on the other end and paid for a gun you can't receive. Good luck. Let us know what happens.

I'm a NY resident, and I feel that this is just playing into the anti-gun agenda. Look at most auctions or gun sales, and most include that it is the buyers responsibility to make sure all local and state laws are followed. I have seen a few guns that I would have bought, had they allowed a sale to someone here. No bad mojo here, just bad politicians.
 
Clicking on Buy It Now formed a binding contract.

If you remove the double action sear, it will be CA legal. The sear can then be reinstalled in the People's Republik of kalifornia.

Any competent gunsmith, and many amateurs can convert, then reconvert the revolver.

Do not forget to post negative feedback to your unscrupulous contract breaching purported buyer.


The revolver could be transferred in Ca using the 'single action' exemption. Sound like the buyer is having second thoughts.
 
Thanks for the replies. It's a Model 17-4 that I bought in 1981, IN California. I'll contact GB and see what my options are. I will also take your advice on "no sales" to California, if I re-list.
 
In a situation like this I would normally recommend good communication and make every attempt to resolve any misunderstandings with the buyer HOWEVER this buyer sounds uninformed and seems to have a bad attitude so I would suggest not attempting to force the deal because it will be too much trouble, frustration, and not worth the effort.

I would recommend, possibly after giving the buyer one more chance to respond, filing a non-paying buyer report, relisting your gun, and giving the buyer an F for Failure to payer or use a brain. I think you might be opening yourself up to heartache offering the single action conversion suggested previously but if you do and it works out then good for you. Good luck. Sorry for your troubles.

Ironically I was reading a surprising article this morning that leaves me even more dumbfounded in the context of this thread. Apparently you cannot sell, or it's very difficult to sell, an old .22 LR revolver to someone in California BUT according to Janie Harr, Associated Press, in the San Jose Mercury News, "After a new law went into effect in January, more than half of all new driver’s licenses issued in California this year have gone to people who are in the country illegally, the state said Friday."

Confused look on my face ...... fingers scratchin' my head.

I'll agree on it seems to be a case not only of buyer's remorse, but buyer stupid. If he knows it isn't allowed into California why did he bid on it. Oh, that's right, he didn't bother to check until AFTER he hit buy it now. And his assertion that it isn't a S&W because it's a Bangor Punta is laughable. He's grasping at straws. Negative feedback on him would be appropriate.

I hope when you re-list it your $1100 bidder finds you again. You might even mention that it's a re-list due to non-paying bidder.

Not a big seller to CA so this might be wrong, but I thought the Single Action Only loophole was closed via legislation that went into effect Jan 1st.

I recall selling a S&W last year and it had to be within the CA border by the 20th of December or something like that to make it under the wire

Yes petermari I know it is not Kalifornia,just kinda of kidding about the name. Yes I do agree it is bad politicians that people keep voting into office so who is really to blame ?
 
Pity that California has such issues with revolvers. I would love to buy it, but the $$ are beyond my budget.

I make a point of checking all the details for an on-line purchase, lest I be in such a situation.
 
We are all our own worst enemy. Hopefully one day Cali will come around. It is a Beautiful place with a lot of really good hearted people.
 
California laws make my head hurt.

No double action 17's, but my company ships AK and AR receivers there no problem.
