03 FFL Question

Thinking that I should finally apply for an 03 license. If I had done it 10 years ago I would have save a bunch in transfer fees. My question is, I have an LLC for some consulting work I do. Should I put the C&R in the name of the LLC or just my name alone. The benefit of the LLC is that I could add members, think son.

Second question, once I have the C&R, should me pre C&R guns that qualify be transferred into the C&R.

Question #2 If I sell something on my C&R that I've owned, I just note on the page that it was 'previously owned'.
Would ATF find that acceptable??????
 
I have not acquired or disposed of anything for many years either using the license or not. I use it for online discounts now, but keep it just in case.

You don’t need to put currently owned C&R guns into your book, but if you dispose of any then yes.
If you buy a C&R gun without using your C&R it still goes in your book.
I’m sure the experts will soon arrive to add or correct.

I have had a C&R for about thirty years now. My understanding is that the C&R is not a business license and must be in your name only with your home address on it. If you already own C&R guns as far as I know there is no such thing as transferring them onto your license.

I’ve had one for a while. Never really dug into aspects you pose but based on everything I know Alwslate is correct. Needs to be in your name and home address. I definitely recommend getting and using.

Just FYI
I always keep a few copies with me when I drive from OK to TX. The Cabelas in FW known to have the occasional vintage revolver. And it’s nice to just use the C&R to buy and take possession immediately. (Assuming it’s qualified). Although they will ship for free to any local Cabelas or Bass Pro. But for the impatient like me it’s just satisfying to get now.

There are a few retailers who will not transfer to a C&R where I live. No big deal. In that case I just do the normal trf process.

And of course if you go to a gun show out of state it comes in handy for qualified guns. I’ve seen a lot of the guns you like and I’m sure you’ll find it useful and worthwhile!
 
The C&R is explicit, "This license does not authorize the holder to engage in the business of dealing any firearms." And so stated right on the face of the license. It so being I would not permit anyone else to utilize it for any purchases or sales, only the individual to which it has been issued.
 
My understanding of an FFL/03
It is for you to collect older guns, no others.
You can buy and sell to enhance your collection but a bunch of buy low, sell high or for-profit transactions can be considered doing business.
Guns must be stored at the FFL address.
If you have a collection prior to getting one, no need to add them to your bound book.
If you sell from your prior collection, I don't think you need to enter in your book. verify this, but it wouldn't hurt.
If you get a modern gun, you can't use your 03. No need to put in your book.
Verify you state laws, carefully. They seem to change frequently.
Most free states will allow you to purchase C&R and have them delivered to to.
If you sell into another state, verify, verify and verify again the receiving state's laws; here be snakes and dragons.
Purchasing C&R's from out of state while visiting, check that state laws.
The ATF 'can' audit you but keep your book up to date, so no problem.

Like mchom said, keep a few unsigned copies JIC you find something.

Truthfully, this would be my primary reason for having it. I travel a good bit, I always stop in gun shops, and I split time now between here and Pittsburgh, so if I find something up there I presently have to have it shipped here.

I filled out the application and am mailing it tomorrow.

As to C&R eligible guns, any gun at least fifty years old is C&R eligible. And some modern guns also such as commemoratives like the many versions of the Winchester model 94. Also some of the stainless reproductions of the German Lugers. There is a full list of C&R eligible guns on the BATF web site along with the regulations for the use of the license.
 
I've taken advantage of my 03 FFL while traveling. Has resulted in my acquisition of a few good ones. I live on the boarder of another state, and there is always one in my wallet, and a few more in my car.
