On June 9, Representative Larry Pittman, R-Cabarrus, along with three other Primary Sponsors and and six other co-sponsors, filed House Bill 1148.

It passed the first House vote on June 13.

It is now in the committee on Rules, Calendar, and Operations of the House.

This isn't just any bill. This is a bill to amend North Carolina's state Constitution.

H1148 would expand gun rights in North Carolina, and would take away a portion of the state constitution that allows lawmakers to create restrictions on concealed carry handguns.

Representative Pittman doesn't beat around the bush as he writes, "Especially in these times, our people need to be armed...an armed citizenry is essential to freedom and would be a real deterrent to criminals and terrorists."

Mr. Pittman adds, "Requiring honest citizens to go through the process and expense of getting a concealed carry permit is an infringement on our rights. The Second Amendment to the US Constitution...plainly says that our right to keep and bear arms 'shall not be infringed.' It says nothing about special circumstances under which it may be infringed or making the exercise of that right subject to government approval."

If passed, the issue would go on the November ballot for a public vote. If approved by the voters and signed by the governor, it would take effect on December 1, 2016.

So. All you North Carolina forum members...wake up. Just because we're a Shall Issue state and an OC state, doesn't mean it can't be even better for us.

Contact your representatives.

Tell your fellow gun enthusiasts.

If, for some weird reason, you aren't registered to vote, please rectify that soon as possible.

If this makes it to the ballot, you need to show up at the polls in November.

This is an opportunity to make a difference, to have some say-so on how our state regulates our gun rights. Like it or not, the state will regulate your rights at every opportunity. Why not let your lawmakers and governor know that it's time for some changes?

Here's a link to find your representatives for your district. This will give you their email address to contact them in support of this legislation. Please let them know to support HB1148. They need to hear from every gun owner in North Carolina.

What would the effect be on the requirement to get purchase permits?

PPP's won't change. You will still need a pistol purchase permit or a concealed carry permit to buy a handgun.

Even if this passes I will still keep my concealed permit due to the reciprocity if traveling to another state but it is still a step forward.
 
The House Speaker has announced he will not bring this to a vote. A referral to House (or Senate) Rules Committee is a death sentence for a bill.
 
You are correct. I have emailed Speaker Tim Moore about this nicely asking him to let this move to a vote and let the people of the state decide. For you folks that would like to do the same, his email address is:

If enough of us band together he could "change" his mind.

The bill isn't dead yet, and the legislative session isn't over by a long shot. Just because House Speaker Tim Moore (R-Cleveland) says something doesn't make it so, and doesn't mean North Carolina gun owners should tuck their tails between their legs and slink away from the fight like whipped dogs.

The Speaker and Committee Chairman David Lewis (R-Harnett), have both been swamped with phone calls and e-mails from their constituents urging them to give second thoughts about delaying/killing H 1148.

Tim Moore and David Lewis both will be up for re-election in November. North Carolina voters would do well to keep that in mind. If your elected representatives are working against you, working to deny your rights, it might be time to start thinking of letting someone else do their jobs. The NRA would probably tell you the same thing.

Representatives Moore and Lewis have already heard from me...and not for the last time, either. Keystrokes and mouse clicks make it incredibly easy to let elected officials know what's on a voter's mind regarding pending legislation.

All other North Carolina gun owners, collectors, shooters, and sportsmen need to start using their computers and phones for something other than posting on Internet forums and sending text messages.

These are our guns and our rights. Talking about it on gun forums isn't gonna get the job done.

 
True CC and PPP's seem to be at odds :confused:

If someone had no gun and wanted to purchase one to exercise CC, how would he/she without permission?

AFAIK, in CC states, you fill out a 4473 and leave with your handgun, no Sheriff/LEO permission needed.

People wanting to purchase a handgun in North Carolina aren't allowed to do that. Unless maybe you already have a handgun from long ago or something. Have to have that purchase permit in hand to buy from a licensed FFL dealer. Like it or not, no FFL person will sell you a handgun in this state without the permit. Legally, that is.

There are other states that require a purchase permit, but not many. And some states even require a permit to purchase a long gun.

The whole handgun purchase permit system in North Carolina is sort of like something that's been grandfathered in. It's been in effect for so long that people just take it as a matter of course. I think it's come up in the legislature at times, but it still remains in force.

It's also a bit of a power trip thing for county sheriffs, especially those in the more rural counties. Some hayseed sheriff (and yes, we have a few of those in this state) can decide, hey, I don't want ol' Bobby Ray to have a permit, so I'll deny it. The permit system is also a revenue generator. Each permit costs five bucks. That can add up.

Oddly enough, the questions asked to obtain a purchase permit are more or less identical to those asked on the 4473.

But once you get your NC CHL, you no longer need a purchase permit to buy handguns. You can buy as many as you wish.

As I've said before, we're open carry and shall issue here...but there's always room for improvement.

Watchdog, our S.C. House legislators passed last night on the back of a Georgia reciprocity bill to do away with CWPs. It still has to go to the Senate and all agree it won't make 'the show" this session. Maybe next term!!! Like you me and mine are in favor. Hope springs eternal!!
