an interesting situation that happen to me tonight

I disagree. Cops ALWAYS put their hand on their weapon when approaching a car at night. I KNOW they would have their hand on their weapon when confronting someone breaking into a car!

Are you kidding? There is not a competent/professional LEO in all the land who would consider "use" of a gun in the instant situation, as described.

Be safe.

Be careful there.

JTpur's personal page looks like he is competent and qualified to make his point.

Also, he is from TX where the law regarding the prevention of theft of personal property gives the property owner a lot of leeway.

Also I would like to point out that you are from MD where the cops are notoriously over aggressive.

One must presume jtpur is speaking as a private citizen as he states he would not "detain" the suspect.

He also said it "aint worth shootin someone over a car break..." (sic)

Plus, any professional law enforcement organization has continuum of force guidelines. Seriously doubt any of them start with deadly force in car clout incidents.

Your Maryland analogy is a non sequitur.

Don't know how you know these "facts."

I made thousands of car stops and didn't always have my hand on my gun. There were, of course, occasions when I did, but it was hardly "always" as you aver.

Be safe.

I have been in law enforcement since 1963, four years USAF AP, 26 years active and 20 years reserve. My last five active years I was a sergeant in Internal Affairs. I investigated many officer involved shootings. In every case, whether the shooting resulted in a death, injury or miss, the officer paid a mental toll. Albeit, some did not appear to be affected by the shoot as others, however there were those whoes lives were grossly, negatively altered. There were also a few that "appeared" not to be bothered. In any event, using deadly force is life altering.

Spot on.

i would have drawn down on him and asked him if he felt lucky punk. if he moved i would have kicked him with a tactically placed kick and hit him with my drawn asp, handcuffed him and told him he was lucky to be alive.

i then would have left without removing the cuffs. i may or may not have shot wildly into the air at the time of the incident or after.

then while driving home i would take a sip from my flask and laugh it off.

sorry i was watching a movie, i confused it with reality.

my goodness, i would never of even went by my car if he was right next to it. you do have a cell phone right, stop where you are at, take cover, phone the cops, and place your fee hand where it needs to be.

even if he were in your car, take cover and call the cops.

or just sneak up and put one behind his ear, that would learn him.;)

I disagree. There are countless times I have walked up on a dealer, thief or traffic stop without my hand on my sidearm. I will print the car and my hand will be empty and near the sidearm but seldom on it.

Back in the late 60's, I had a beautiful duty holster that developed a comfortable bend when sitting in the car. The rig had a snap at the top that allowed the holster to swivel rather than drawing the gun. It held a nice .357 with a four inch barrel. I wish I still had that holster or one like it today. But the snap was undone on many occasions but the hand was not on the gun.

It is a shame that we have to worry about confronting and running off someone meesing with "our" property---but, the legal system can mess you up!!! That jerk could run down the road and say he was minding his own business and somebody pointed a gun at him saying he was gonna "blow my head off". Now---think what the police are gonna do.

What do you think??? Door number 1, 2 or 3?

well I just guess I have to say something here. since it seems my comment is being used. Had I been on active duty as was once the case and had I either been sent to a car burglary or stumbled upon one in progress, you can take it to the bank my gun would have been out and pointed at the crook. I would have told him not to move.....you see people that break into cars sometimes are armed and sometimes they arm themselves with the gun you left under the seat or in your glove box because maybe you dont have a permit to carry concealed but can keep it in the car...and sometimes crooks who break into cars are armed with screwdrivers, tire irons and others things normally not considered a weapon but that can easily be used as a weapon, and I spent most of my career staying out of the emergency room getting my head stiched up, or the knife wound to my mid section repaired.....(got smashed in the eye socket once with a hammar wielding husband at a domestic once) so you can bet my gun would have been out.....I was usually able to convince most bad guys I was nuts enough to shoot so they never tried that "do you feel lucky punk trick." I did not say I would have shot anyone as a cop or as a civillian and over a car break I would not...but when the guy breaking into a car turns it into an attack against yours truly, well he better not be taking his knife or whatever to my gun fight....and after over 25 years in the business and not a reprimand in my file I will say that I was and still am pretty competent...

If you had gone to my car being ripped off, back in the mid seventies, you would have had to deal with a street punk armed with a Smith Model 29.

Found under the front seat.

Since guns are one of the top things on their list, it pays to be prepared.
