I was picking up some reloading supplies today, and there was a guy trying to buy a Stoeger Coach Gun. The clerk called in his 4473, and the guy was delayed, but not denied. The guy about went nuts, and the cler told him that there wasn't anything he could do at the moment. The guy still went on that he had never been arrested or charged, which after a couple of minutes gave way to "except for that bar fight, but that was only a misdemeanor." Still the guy kept on a bit, and finally the owner told the guy that they would call him when the sale went through.

I saw two "guys from the hood" In my favorite gun shop a while back trying to buy a riot gun 12 ga. They ran the guys check and it came back bad. Same store he broke for bad. When he calmed down he told the saleman to run his buddy's record "he will buy it for me because he is clean.

Needless to say no one bought a gun that day from that store

I would have let the other guy start filling out the form, and phoned the police to report a straw purchase in progress. Then, the other guy would no longer be clean!

I've seen the delays discussed on other forums kinda like we discuss Walmart receipts here. Lots of opinions, not a lot of facts.

A friend of mine was delayed buying his first gun; our best guess was the juvenile stuff he did a long time ago required a closer examination of his record.

I've never been delayed (knock on wood) ... but if I am, I am. A delay doesn't mean you lose anything but a couple of days.

People need to chill.

I think a person can be delayed with a perfect record.
I dont know if NCIS thinks one person may be another?
I went a long time with out problem but here lately I have been kicked back for a bit.
It is odd. I dont get delayed every purchase.
Who knows?

I have been delayed before.
Might have been as simple as their computers were down, but who knows, they don't explain why.
Picked up my gun the next day, no big deal.
 
I had a guy get delayed once. He got unnerved, but not at me. He had a clean record, he says, and I believed him. He worked for the local major power supplier in the area and he has private clearances for his job. It may have had something to do with that, I don't know.

The biggest problem is it was a special order and he drove 45 miles to come pick it up, only to find out he had to go back home empty handed. Then come back days later. I understand. I cut a break on his money to help out. I wound up not really making much on the deal, but hopefully I gained a repeat customer.
 
I'm trying to remember the last weapon(s) I bought back in Illinois? It was either 24 or 48 for a long gun and 3 days IIRC for handgun? Memories cloudy on FOIDland's rules now? Maybe that's due to being able to see it growing smaller in my rear view mirror? I don't know how the NICS system affects purchases there. But you got really accustomed to delays as well as second or third trips there. That dude would have unwrapped there!
 
The last three guns I bought took an average of 10 minutes each. Of course I have nothing in my record and the # of life time traffic tickets can be counted on one hand and not all the fingers will be used.

That's what's lovely about my CCW permit in GA, the only delay I experience is how long myself and the clerk take to write up the paperwork. CCW means no background check here.
 
Somebody who goes "Ballistic" over a delay just might not be the ideal person for firearms ownership. Without enough mental hospitals still open we have a very large number of people out on the streets who simply shouldn't be there. Is this guy the next one to go into a shooting range and rent a gun to blow his brains out or someone he bringing with him???
 
I stopped to browse at a rural gunshop near the Alabama/Florida line about a year ago.
Older guy had just been denied the instant check, and he turned to his younger counterpart (maybe his son) and said, "I guess you'll have to buy it for me."
The clerk quickly nixed that idea and the older man was not happy at all. I left about that time, I really didn't want to be a witness if it went downhill from there!

I bought a 642 for my wife and while filling out the form I mentioned to the dealer it was for my wife.
He about fell over!
Said he couldn't sell it to me.
I told him it was mine and fogettabot it!
He agreed to ***ettabot it.
 
There is a difference between a gift and a straw purchase, and in my mind it boils down to whose money is used to buy the gun. If you buy a gun for your wife with community property money I don't see how it could be seen as a straw purchase. It's either a gift, or a community property gun. Either way is OK.
 
I wouldn't agree in that case that it was a "real" straw purchase. You can purchase a gun and gift it. You still are the actual buyer. But I would only do it if I knew you well.
 
Jeb, I think the clerk was misinformed.

You can buy a gun as a gift for someone who is not a "prohibited person,"

In the space where it asks "Are You The Actual Purchaser," the answer is "Yes" since you are, indeed, the purchaser.

ATF has addressed this at least twice in their dealer bulletins over the past few years.

Right on the 4473, gift purchases are A-OK...

Lots of folks don't know the details, and even those that do may not be inclined to follow them exactly. When dealing with an agency known for "creative" interpretation, I can understand wanting to land on the conservative side of things.
 
A good friend of mine always got delayed the full three days because he had a police record. Of course he had a police record, he was a retired cop!
