I'd like to send my son a Ruger Single-Six revolver for his birthday. He lives in Austin. He does NOT possess any kind of license/permit from the state of Texas for firearms. Is it legal for me to send him this revolver via FedEx to his home address or must it be sent from my local FFL to FFL in Texas (I live in the Peoples Republic of Massachusetts)?
Does he need ANY licence/permit/training certification to possess this gun in his home? He would use this gun on a relative's property an hour away from Austin for target practice. Is it legal to carry/transport in his vehicle/use on private property without any permit? Sorry for all of the basic questions but I want to make sure he is good to go before I send him this, his first, firearm. He is an adult over 30. Thanks.

You are a nice mom. As DGM indicated, have your FFL send it to an FFL in Austin, TX. If I may suggest a local FFL that I have used multiple times in the past for firearms transactions is GT Distributors:

They are primarily geared towards LEO and first responders, but ordinary civilians are allowed to shop there as well. I think you will be pleased with them.

thanks gor the info. I will ship to an FFL. Any cost associated on that end with the ffl transfer. $30 or so here for the FFL to do the "paperwork" (state registration!!) on a handgun traded here. How about Texas?

Send to an FFL especially since it's crossing state lines.

As for transporting it, if he is legally allowed to be in possession of a handgun, keeps it concealed, isn't committing a crime other than a traffic offense, has it concealed, and isn't part of a criminal gang he can carry a loaded handgun in his car on public roadways under the provisions of the Texas Motorist Protection Act. However, he cannot exit the vehicle with the gun on his person except that he's transporting it to or from his home/business. He does need to be 21 or older for all that to be true, in Texas, when it comes to a handgun. There is no special certification or licensing to own a handgun. He just needs to get the thumbs up at the background check. At home, he's in control of the property and he can carry/possess as he pleases. He is responsible for the actions of those who might get a hold of it, however. On other private property (non public accommodation type property), that's at the discretion of the property owner.

There are no possession-type licenses for firearms in Texas and no registration. Unless you want a carry license you're good to go in re ownership. Short answer in re possession and carry is it's fine at home and fine if concealed in a vehicle. After that it gets complicated but if he wants to be a gun owner in Texas he can easily find the rules.

FFL to FFL is required for an interstate transfer like that.

If he carries it unloaded in a nice range bag in his trunk he doesn't ever to have to even think twice about it. If he plans to carry it loaded inside his car, accessible to him, it must be concealed.

What he does on private property is his business and the landowner's business. Again - there are NO permits for use or possession. Texas only issues licenses for carrying; as of tomorrow that license covers open or concealed carry. If he wants to do that he'll take a class and learn all of the rules.

As a first firearm, I highly recommend training classes unless he's ex-military.

You need to have your son contact an FFL dealer in his area to be sure he, your son, can accept the transfer from the Texas FFL to him. Having an FFL dealer ship the gun is probably cheaper than trying to send it yourself. If you send it yourself, be sure the FFL in Texas will accept a shipment from a non-FFL. Some do, some don't.

Does the $30 on your end cover shipping costs or only the FFL handling charges? He has to record the firearm in his bound book, then log it out when shipped to the receiving FFL in Texas. I'm confident the Texas FFL will charge $20-$30 to transfer the firearm to your son. Depends on the FFL: charges vary in my area (Wyoming). The Texas FFL will be required to do a background check as well as log the firearm in and out to your son.

Before you ship, be sure your son is eligible to accept a firearm in Texas. I don't know the law, but the receiving FFL will. As your son is over 21 and can correctly answer all the questions on the Form 4473, there should be no problems.

But it ain't cheap. If you have not already purchased the Ruger, it will be cheaper to send your son the money so he can buy the handgun locally and avoid all the FFL fees and shipping charges.

My last FFL transfer was a few months ago, and GT Distributors charged me $25.00. Some FFLs around here charge more if you don't have a valid Texas CHL, but GT charges the same whether it's a long gun or handgun, if you have a CHL or not.

I just read that open carry was voted in in Texas but may have a date before being legal

Open carry will become legal in Texas as of midnight tonight, January 1, 2016. Of course you will need to possess a valid LTC (LTC License to Carry, formerly known as Concealed Handgun Licenses or CHLs).

It could be more practical to have him buy one locally. If someone here could suggest a good shop as a start - That would also allow him to choose a model/finish. It might have to be ordered by the local gun shop, but that would also make him a real customer.

Practical? Perhaps, but not nearly as special as a gift from his Dad. FFL transfers are easy and a few dollars are no big thing. Gun ownership is 90% common sense tempered by 10% of legal requirements.
Now, does he have any practical experience in handgun ownership? Use as a kid, Training? etc? If not please convince him to take a basic handgun course.

Just being ex-military may meet the state requirement but . . . I know an Army Captain who retired earlier this year with 15 years service and never got a lick of firearms training! :eek:
 
Most all the info appears accurate, however, your son must be a resident of Texas and able to prove it. Drivers license will do.
