Boy mistaken as transpasser die after shooting

I'm not sure what to think of this, not enough hard facts to form an opinion, however IMHO shooting transpasser outside ones dwelling without warning will not endear the shooter to the jury, not sure how the court will react to this under Texas law. Members, what do you think?

Shooting into pitch darkness doesn't sound good. But stopping "to use the bathroom" near someone's home doesn't sound too good either.

Maybe there have been a lot of home invasions in the area? Agree that more information is needed before condemning anyone.
 
From the info, it's hard to tell if they were
actually on their property, or just skirting
it on some kind of road.
Myself, I think the charges will stick.
They may even upgrade to murder if they haven't
already.
The people in the truck were not a threat.
They were just driving a truck near or on their
property. Shooting a 12 gauge at them was not a
good idea, and it's not something I would ever
do.
So as far as I'm concerned, string em up.
They shot and killed a 7 year old kid.
They are going to have to pay the price
for being stupid.

If I had a fat wheeled SUV tromping across my
land in OK, I would not blindly shoot at them
even if they were totally on my property.
I would walk up to them , gun in hand, and
demand they vacate the premises.
ONLY if they tried to attack me, might I
consider shooting at them. And I'd be danged
sure of what I was shooting at first.

I can deal with trespassers in court. I have
a posted sign at my gate. I don't feel blindly
blasting away is a viable option.
It's rednecks like that that give the rest of
us a bad name.

Posting a sign like that in front of your house is an incredibly stupid thing to do IMHO. It would remove any doubt whatsoever that the shooting was intentional and that the warning applied to anybody regardless of age or circumstances. I suspect a Texas jury is not going to miss that point either.
 
Whatever Texas law may be, blindly shooting into a truck full of people who are not a immeadiate threat is just wrong.After seeing that sign there is no question of intent and murder charges would be in order for such reckless behavior.......God Bless......Mike
 
That trash needs to swing by the neck and I somehow feel that justice will be served in Texas.
 
Even if they were on the owners property, they overreacted. That was a situation in which they should have called the Sheriff and then remained vigilant. If they had done that to my family they're best bet would be to beg the judge to put them away for life. I wouldn't be able to get at them there.
