The Judge in my section will NOT come to court due to the covid scare.She is now a ZOOM convert. We had our first ZOOM session yesterday.:rolleyes:
She is on TV,The court reporter is on TV. The clients at Jail are on TV. The DA and I decide to at least go to the courtroom to be on TV. Other defense lawyers are scattered to the wind but are all on their TV's The DA had to leave due to feedback.So I am in the Courtroom,the DA is in the jury room, the clerk of court is down stairs and God only knows where the Judge and Court reporter and law clerk are. We start to creep along on stuff that doesn't require testimony and surprisingly things get done bit by bit. SO all of a sudden the Judge calls up a preliminary exam with a deputy on TV from who knows where and she expects that I and my client will get a fair shot at cross examination(remember that there is no human to human contact-everyone is on the ZOOM screen). I politely point out to the Judge that their is a code article that prohibits remote witness testimony and that no judicial fiat, order from the Supreme Court or executive order from the governor trumps clearly spelled out law. The DA is in total agreement-the judge in a remarkable display of judicial arrogance and activism says she doesn't care what the statute says, that the pandemic trumps everything and this is the way we are going to do it.Thank goodness my client is on the street(although he was not allowed in the courthouse and is sitting at home on his cell phone because he doesn't have a lap top). I move for a continuance and the DA joins as he has the same concerns as I. We continue the hearing until November at which time I think that I will be exposed to the Covid and will have to self quarantine(in a duck blind ;)) until next year when it won't be my problem any more.
I understand the distancing thing, but DON'T think that I can in any way do a competent ethical examination of a witness remotely with me being the only one in the room. But as long as I am wearing a mask and have ZOOM it's all good. :rolleyes:

I have averaged approximately 10 zoom/conference calls a week since this all started. If I wanted to, I could spend most of my days doing those meetings but I don't since I have work that needs to get done.
 
It's like these masks have become fashion statements around here. Everyone is trying to find the cutest mask, and will proudly wear them driving down the road, all alone. I even saw a guy on a motorcycle wearing one. The whole thing is overblown, if you ask me, which no one has.

I can imagine how odd it must be to hold court like that. We've had pre-construction meetings like that a couple of times. And I sat through one "virtual" public bid opening, where the public was all hiding in their offices while one guy reads the bids, and another fellow records them.

Used to be that the apparent low bidder was asked to stay behind and answer a few questions. Now all we get is "We'll be in touch with the apparent low. It takes days to find out if you did any good or if the project is even in budget. I don't care for this Brave new world myself.

It's like these masks have become fashion statements around here.

Nothing shows you care as much as wearing a mask. It's the new, ultimate "in thing" to do by virtue signalers everywhere. And don't expect them to give it up any time soon, some people live to bully and harass others into submission, and this mask thing has become a powerful tool in their march towards a universally uncivil society. Around here we have roving bands of old ladies, surely widows that killed off their husbands with their charming personalities, calling the police and harassing the evil no maskers. It really has become insidious.
 
Wearing a mask for corona virus protection is like having a chain link fence stop mosquitoes in your back yard. On my trip to the hospital for a blood draw, 3 nurses agreed with me. I don't know about brave, but we got stupid down pat...

Used in the manner by which I see most folks, you’d be right.

Pulling mask down to talk - not correct
Mask under nose - not correct
Touching outside of mask - not correct

Actually using a mask correctly and avoiding contamination helps curtail spread of disease, period...nobody needs to believe in Germ Theory to actually contract a pathogen.
 
That kind of stupid stuff has been going on here since March and will continue at least into August. Fortunately, I am no longer part of “the system.” Every time I talk to my successor I thank God for that! You have my sympathy, Sir.
 
The primary way I'm examined by doctors anymore is to do it over the telephone. I believe they call it a "Televisit" or something like that.

Wife has been doing lots of court business in Montana via remote. Been that way here from way before the virus. Distances, weather, etc etc. Not criminal hearing though.

But, the clerk of the local court was telling me they were going to do a jury trial. Social distancing, nurse in attendance. recesses between witnesses for sanitation of the witness box, etc etc etc.

You may come to prefer remote. LOL
 
File a speedy trial motion and assert the defendant's rights to confront witnesses.

Will get the judge's drawers in a bunch.
Speedy trial delays were tolled until June 15th. But they're running now!!! I have an evil judge one that everyone despises. I have already told my boss as well as the DA's that I am NOT pleading anyone who is not in jail because #1 I'm not recommending anyone on the street tale jail time (and they wouldn't take it anyway :D) and #2 I would be committing mal- practice if I were to allow any of my clients to be on probation with this particular Judge. I am just so discouraged. There is NO WAY that I can ethically represent anyone under these strictures and this Judge , alone among the other judges, is forcing both me and the DA to do stuff that, a is distasteful to me and violates MY ethics and as far as te DA is concerned gives ample appeal grounds on the confrontation issue and grounds for post conviction relief. It is so bad we actually Joined in a motion asking that she not conduct live testimony hearings over ZOOM! She denied it and the DA is now taking writs. So we shall see, In the meantime the criminal justice system, at least down here is getting totally clogged up and I have no reason to believe it is any different anywhere else. This is the kind of stuff that doesn't make the news but it's gonna get worse before it gets better. I'm not agreeing to any jury trials unless they ate liver and it is going to be next to impossible to seat a jury with the covid concerns so I expect come November 1st a lot of bad people are going to be getting out of jail when the speedy trial writs ripen and get filed.
 
I won my first "computerized" tax case last week. The judge, government attorney and I were on camera. My "Boss" was home with the camera turned off. Between my brilliant arguments, I could hear what sounded like the crunching of potato chips.It is hard to beat the government on collateral estoppel, but I managed this time. The period of appeal expired last week and the government declined to appeal. Maybe this is not so bad, especially if you are sitting in your pajamas eating potato chips.
