CCW while dropping off kids @ school

Sorry, Drew Edmondson (OK AG) does not give official opinions to private individuals, only state agencies. The AGs in most states have a similar policy, so I'm not surprised at the Idaho AG's answer.

Fortunately, the OK statute is plainly and clearly written.

My personal opinion is tht the Idaho statute is also fairly clear, but IANAL.

I've contacted Edmonson's office and several other state's AG office about CCW and/or peaceable journey laws and someone in all the offices have always answered my questions. YMMV
 
Just another caveat from Lawyer's Corner: Even if you get someone from a AG's office to answer your question, don't always count on it being right. (OKFC is correct, as to written AG opinions-not gonna get one for a private citizen. Oral opinions, you might get, but beware if you do.)

Here's a for instance, even for written opinions: When our CHL law was first written, in 1995, it was reasonably clear, most of us thought, that "premises" meant "building" under the statute, and that carry on parking lots, etc., was legal. Our then-AG, whom I believe is still today incarcerated in a federal pen, wrote two opinions, saying that "premises" meant any property controlled by the school (or other appropriate entity.) In 1997, our legislature fixed it, defining in the statute both what premises are, and just in case the reader is as dumb as our ex-AG, what they are not.
 
Help me through this one...I want to carry legally & I understand the all the no-no's...except the most common application...carrying concealed while droping off /picking up the kids @ school. Idaho statutes state that it is OK while dropping or picking up BUT when I ask a friendly deputy sheriff, she states "ZERO TOLERANCE, no guns on school property" even when we were discussing having the permit. THIS BLOWS ME AWAY, so I send a friendly e-mail to the local sheriff's office for clarification (they give out the Idaho Permits) & they don't respond to my e-mail...

Today I get a letter from the Prosecuting Attorney's Office saying that my question was forwarded to them...& goes on to say that they can't give LEGAL ADVICE to the public, & encourages me to seek the advice of private council regarding Idaho State law...In addition, I may want to consult the Federal Gun Free School Zone Act to see if this federal legislation preempts Idaho Code...

Oh my god, am I the only one that would carry (& have school kids)...(NOT). Are the gun laws that screwed up that I can't get a simple straight answer?

Why would some Anti-Constitutional federal act trump the state law, anyway? Who wishes to OPINE?

Typical government response; sounds like passing the buck to me.
 
Just because a LEO picking up a kid is not carrying and exposed gun does NOT mean he ain't packing . . . same with a non-LEO citizen, honest or crook.

Although Idaho law seems to allow you to carry does not mean that one won't be arrested one day for doing so legally. That's when lawyers come in and the laws get tested.

Most laws seem vague enough that I call most of 'em "Lawyer Right To Work Laws!"

I'm licensed to tote in my state and other states that reciprocate . . . and "concealed is CONCEALED." No one will know it is there unless I need to use it anyway to protect me or mine against an impending mortal attack. Ummmm . . . that's the whole point of "carrying" anyway!
