Thanks for saying that, Chief. I always thought "Shall not be infringed" was about as absolute a statement as the English language can make.

Somewhere along the way some weenie weasel lawyers started talking to judges about "reasonable", "everybody knows" and "commonsense", words that make me angry or give me chills every time it comes out of some pol's weasel mouth.
 
New Jersey has some strange and harsh laws. Unless it has changed recently, you get a mandatory jail sentence for each hollow point round you are carrying. I do not go to NJ, MD or NY because they are so hostile to gun rights. You need to be familiar with the laws of the States you travel through.
 
I have seen an article that asserted that LEOSA provides an affirmative defense, but my research at the time leads me to think that the assertion was not sound. I believe that there have been some cases decided that do not support the affirmative defense argument, and to the extent that it may be correct, so is possession of a lawfully issued carry license.

Since state law here is broader than LEOSA on out of state LE carrying, it is not an issue here, but if it happened, my advice to our criminal division would be to charge the arresting officer. I doubt anyone in my client agency is that dumb, but if it happened, I would be pretty firm in advocating discharge and de-certification. I can't think of any alternative to such.
