Got my 317, Not Happy

Well my 317 came in and it is supposedly new in the box.

Here is what I found:

scratch on frame

grinding inside?

Course the dealer isn't responding to email on Gunbroker and since I told them I was emailing pictures they won't answer my phone calls...

S&W said they would look at it, but not sure if they will be able to do anything.

I guess I will need to start a dispute with my Credit Card.

The dealer on Gunbroker is Tooties

Mike, I would not be happy either. Let the factory have a gaze at it, but buy all meens, post a BAD deal about gun broker on this site, under transactions. That is unexceptable, i wish you well.
 
Well I do have to compliment S&W, the fact that they would even look at it says something. I have a feeling that after this these guys won't be dealing directly anymore. How someone could try to pass this off as NIB is beyond me. And the guy has a great rating too. I am going to give him til tomorrow afternoon to make this right and then its BBB, credit card, and who ever else I can find that might make a difference.

Ohio Guy please read the rules. Only transactions that took place on this forum can be reported in the feedback section.
 
The scratch looks like somebody slipped with the Dremel. What are the chances it left the factory that way? Definitely check with S&W to get their opinion.
 
If thats actually scuffs inside the frame, my bet is someone dropped it with the hammer cocked?? Possibly tweaked it, causing both the scratch and the mis-aligning.. Either way, I'd be wantin a refund if I paid for "NIB".. Best of luck and keep us posted!

When I look at it, it does look like a dremmel job... and that lines up with the scratch on the outside of the frame... And I wasn't going to post feedback here, but I thought folks should know what this guy is selling as NIB as he has other s&w...
 
Well it would appear that they are dodging my calls... No one answers when I call. They have til 5 pm to take care of this then its off to credit card dispute land.
 
After faxing them and letting them know this wasn't going away, they have agreed to send another one out. They don't seem to argue about the dremel assessment. Interesting...
 
What would you guys say the value of the gun is? I am worried that I will ship this one to em and get nothing...
