Govt is going after the low hanging fruit-this time ghost guns

I've had some heated discussions with kbm6893 in the past. We smoothed things out, I do not consider him my enemy in any way.

I think my 2A stand is equal to anyone on this forum.

I'm a dreamer.

I don't consider anybody on this forum an enemy. It's ok to have a different viewpoint than others. If I insisted on people sharing my viewpoint I'd have a lot less friends and more than half my family would be cut off.

What will be, will be. Either live with it or against it, and accept the consequences either way.

Not really. A gun control law which said you needed to take a free one half hour safety class once in your life before purchasing a gun might be a pain in the rear end, but would not be seen as having a chilling effect on the exercise of Second Amendment rights. Publishing for all to see the name and address of each person taking such a class would have a chilling effect.

Yes, I can see that, but there's a point then of magnitude to a "chilling effect". At what point does the requirement begin to chill? And is the intended purpose of the requirement truly safety or to actually "chill" or discourage the exercise of a right? A free half hour safety course is far less chilling but how bout a 20, 40, or more hour course that one has to pay for. Is having to serialize a kit gun and fill out a 4473 in and of itself "chilling"? Don't know, but it adds at least one more ice cube to the mix.

If it's not registered, it doesn't belong on the streets. Period.

Quite the contrary. All Arms Laws that restrict The People in any way are unconstitutional

Second Amendment

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

"A law repugnant to the Constitution is void. An act of Congress repugnant to the Constitution cannot become a law. The Constitution supersedes all other laws and the individual's rights shall be liberally enforced in favor of him, the clearly intended and expressly designated beneficiary." –Marbury v. Madison, 5 U.S. 137 (1803)

"An unconstitutional law is void and is as no law. An offense created by it is not crime. A conviction under it is not merely erroneous but is illegal and void and cannot be used as a legal cause of imprisonment." – Ex parte Siebold, 100 U.S. 371 (1879)

"An unconstitutional act is not law. It confers no rights; it imposes no duties; affords no protection; it creates no office. It is, in legal contemplation, as inoperative as though it had never been passed." – Norton v. Shelby County, 118 U.S. 425 (1886)

"Where rights secured by the Constitution are involved, there can be no rule-making or legislation which would abrogate them." –Miranda v. Arizona, 384 U.S. 436 (1966)

We are bound to interpret the Constitution in the light of the law as it existed at the time it was
adopted...
[Mattox v. United States, 156 U.S. 237, 244, 15 S. Ct. 337, 39 L. Ed. 409 (1895)]

"It is apparent," this court said in the Bailey Case (p. 239) "that a constitutional prohibition'
cannot be transgressed indirectly by the creation of a statutory presumption any more than it
can be violated .by direct enactment. The power to create presumptions is not a means of
escape from constitutional restrictions."
[See Heiner v. Donnan, 285 U.S. 312 (1932)

Courts should construe laws in harmony with the legislative intent and seek to carry our
legislative purpose.
[Foster v. United States, 303 U.S. 118, 120 (1938)]

None of my guns are registered that I know of. A few of them may have had the 4473 turned in if the dealer went out of business. None of the private sales ones were, those I inherited were not, 2 of my 22s never ever had a serial numbers. None of those I bought online are as they went to an FFL who has only had one check for a certain guns from a certain person and that was by phone.

So, according to a couple people here they do not belong "on the street"

Happy to live in New Mexico where firearm registration does not exist, nor do waiting periods, possession permits, firearms ID cards. etc. Walk in to a store, pay, do your 4473, wait for the call to end, walk out with your purchase.

Yep. And those like him far outnumber the "law abiding citizen" who wishes to arm himself and protect his family. I wouldn't keep a ghost gun if you gave one to me. I surely wouldn't carry one or use one for any serious protection.

Best of luck to all of you as you try to convince Joe Public that this is not the face of ghost guns

MSN
Well, he is no less than "A" face of ghost guns and the risk they represent to the public at large. There's no slippery slope to excising these things, they are nothing less than a cancer to the Second Amendment.
