I did a "buy it now" transaction based on the sellers glowing description of the item.

When it arrived at my local ffl inspection revealed it to be not as described , but much worse very worn condition. I did not do a transfer and called the seller to request a return the gun and get my money refunded.

The seller said he was under no obligation to accept a return , but he would, but I will have to pay for both of his ffl transfers and all of the shipping. If that`s what it takes ok I`m just happy to get most of my money back.

My question is , if the seller lied so in his add is he not also lying now? If I return the gun and he refuses to do my refund what recourse do I have?

I am going to go back to my FFL guy today to get some detailed photos of the gun before we return it.

Any advise from you, my smart forum mates will be greatly appreciated.

its always a gamble.....sometimes its best to cut your losses and keep the gun.....If it were an FFL dealer and not an individual I wouldnt hesitate sending it back. Then, you have his FFL info and could contact the ATF.

Gunbroker will NOT aid you. they are just the intermediary that helps bring buyer and seller together.....
 
I've bought a few online that I was disappointed in. I've never sent one back. There have been a couple times that the seller has given a partial refund and there have been a couple that I have sold for a small loss.

It's probably going to cost you $50-75 to return gun and you still have to sweat out the refund. I'd probably try to negotiate the seller into a partial refund and either keep or flip the gun.
 
I'd call his FFL and talk to them, see what kind of a feel you get from them. Google their business as well and see if it has a website, looks professional as well. If it does and from talking to them, I'd ask about the guy. If he does business with them all the time and they know him, you are probably OK to send it back. If he's some stranger/blow through guy, I'd be leery.

Also, what kind of GB feedback does the seller have?

Were their no pictures to a least make some assessment of your own ?. I have received more good to really deals on G.B. because the pictures are bad. I do have a "learned" ability to look past not so good pictures to assess condition of the exterior,no guarantees on function or bore.I take but a few folks verbal or written descriptions as unbiased especially if their trying to sell me something.

Actually i did not examine the pics with enough care-My fault I know-,but his description made it sound like new in the box, with only 50 rounds thru it, and totally unblemished.
That is what I went on, now when I look at the pics with different eyes I see he only photographed the good sides and not the faults .
He was deceptive on all counts.
I did check his feedback and it`s good. He also has a bunch of other items for sale, including some very high ticket things.
I believe he would not want bad feedback , so I`m going to return it to him and hope for the best.
He`s in AZ I`m in NC lesson learned !
I wont rest easy for at least the next two weeks till I get my money back.

I think you made a good decision. Feedback is a good indicator of patterns. If he has a pattern of being legit, you should be OK.
 
Every time that I've bought a gun on-line, I've used a Cashiers Check. I've had to hold my breath until my FFL unwrapped it and handed it to me. I've been very lucky. However, my FFL shakes his head, and scolds me each time, and reminds me that paying by credit card is the ONLY way to do it. I can stop payment on the card, and he will hold the gun until the seller caves in, and does the right thing. I hope the day never comes, when he says, "Told you so".
 
Good,clear photos are key.I had one years ago that I ended up keeping as I really didn't trust the seller after all the nonsense.I use it to double check my enthusiasm.I only buy with a credit card now.

I think that's the best advice!

I've only ever done credit card deals with larger 'stores' in my internet deals.
 
Over the years I have bought several on GB, and have only had to return one. It was one of the first guns that I ever bought on GB, and it quickly became obvious that the guy was a "scam artist." I did get most of my money back. It did cost me almost $200.00 by the time I was done with the "deal."

ARJAY in the previous post has it right. Good clear pictures are the key. Good answers to questions is another key. Of course, feedback, being able to return, description etc are also in play to getting a successful transaction.

can you leave feedback if you return the gun? if you can, after you receive your money back,i would put it in the feedback. he was obviously trying to misrepresent something. although, you have to take some responsibility too for not looking at the pics closely and asking whatever questions you needed answered.
 
I have bought off GB but I always look for some kind of inspection period, if they won't give at least three days, I won't bite.
 
I won't buy unless they have at least 50+ and NO NEGATIVES. They should also be on GB for at least 2 years. Bought many nice guns but didn't bid on a Whole lot more.
 
I've bought a bunch off GB . Previous posters have given you good advice . Your FFL has also . If pics aren't clear & seller won't communicate prior to sale , don't expect it to change afterwards . Only ever sent one back & I bought it here from another forum member . I was out shipping both ways , but I got 90% of my money back . The expensive leasons are the one's we tend to remember .

This is why there are accidents on the highway, and why all drivers have to carry insurance.

People just don't pay attention, and they end up in a mess with at least one other person.

True, the other driver should have been less cocksure of his right to the road in this case.

Now both drivers are standing outside their wrecks, taking pictures, calling more people to drag into their mess, and both of them ultimately walking away from the incident worse for the wear.

PLEASE PEOPLE.

PAY ATTENTION.

Well I got my refund less the gunbroker commission the sellers ffl fees X2 my $55 shipping etc. all told I lost about $160 on this transaction. It is a valuable lesson learned.

Here`s my dilemma the seller out right lied about the condition and I am out all this money because he lied. I am wondering what are the consequences of getting into a feedback fight with this jerk.

I know if I give him bad feedback he will respond in kind, and while I did nothing wrong -except believe him- I would be tarnished.
Bad sellers like this one really hurt the integrity of the site and I want to report his actions and warn other buyers to beware of him.

What to do???

How is your feedback?

I recently bought a buttstock for my AR that turned out to be a knock off instead of the name brand part as advertised in the listing. I chose not to return the part and hope that the seller would actually refund my money.

I left the seller negative feedback (F) and a factual explanation why. His response was to call me names, accuse me of slander and reciprocate with negative feedback. Since I had 100% positive feedback with good comments regarding fast payment and good communication I was willing to take the hit from negative feedback from a dishonest seller with an obvious axe to grind. If it prevents another potential buyer from being duped, it was worth it...
 
Leave a neutral feedback, but say something like Gun not as described,returned to seller.Refunded money less fees.
Cost me $160.00 to find out gun was well worn.
