NOWHERE did it say that coal and oil were unconstitutional. That is a huge over reach if there ever was one. Plus, it has no effect what so ever on the coal fired generators already running in the state. All of the power from them goes out of state BTW
Actually the suit and decision was in response to Senate Bill 971, a measure barring the state from even considering greenhouse gas impacts in environmental reviews. That is the idea that Seeley struck down in her ruling.
So basically the state government would not even been allowed to consider the effects of green house gasses when handing out any kin of environmental permit.
The ruling simply means they must consider them not just act like they don't exist. In now way does it prohibit new coal mines or gas plants. Just that they have to consider the emissions and the effects on the states citizens before they give out said permit.
As Montana produces way more electricity than it consumes, I for one, am all for keeping OUR air clean even if out of state consumers have to pay more. If you want a shiny new coal fired generator in you neighborhood I am sure we could and would supply the coal.
