Being ticked is an understatement for how I feel but this is a family forum.

I went to buy a handgun. Of course it is a S&W. I have bought maybe five this year. The last was three weeks ago from an individual but the last dealer purchase was about six months ago. I am a commissioned officer in the State. I am an Officer of the Court. I hold three concealed weapons permits. I own a consulting business that does work for law enforcement. BUT today I filled out the form for the purchase. It was called in to the FBI. They then placed a hold on my purchase. No reason given. I was told the hold may last up to 15 days. NEVER in over 100 gun purchases has this happened. I was delayed once due to a Christmas holiday from being approved until two days later. I was delayed once and they called back with an approval before I was a mile from the store.

So I pay out over a thousand dollars for a gun this morning. The store still has the gun I paid for and I have nothing to show for it.

I am really ticked off.

As far-fetched as this may sound - is there some sort of state of emergency because of the oil spill?
 
All of that doesn't mean a thing if there is now a felon out there with a name close or the same as yours. Did you put your social security number on the 4473?

Is it a state hold or federal hold. By law the Feds can only hold up the purchase for 3 business days. I don't know about the state you are in.

You may have also raised a flag by the number of purchases you have made this year, there are a lot of possibilities.

Experience has shown that affiliation with a government agency does not prevent you from falling under the influence of radical clerics of varied flavors.

Buying that many guns in the recent past will probably bring increased concern about your radical intentions. An inspection of your underwear drawer to see if there have been any specific modifications to contain explosives or spare ammunition may be in your future.

Hell, the more I think about it, the more suspicious of you I become!!!!:rolleyes::D

Come to think of it, I may be in trouble just communicating with you.

No emergency here due to the oil spill.

Never arrested. Never had any problem that the police were even needed and if it had been I would have been able to take care of it as an officer myself.

Very uncommon name and I placed my social security number on the form. My first name was popular back in the 20's and many people named their kids after the man that made it popular (he was an evangelist with a roving eye for the ladies). It was my grandfathers name, my fathers and then mine. The last name is not unusual but not common either.

Why the hold I do not know and never heard of a 15 day wait here in Louisiana. The three day wait is legal but I never had to wait before.

I am still ticked.
 
If it was the Brady check through NICS, they HAVE to make a decision within three days - which actually works out to four or five days most of the time, and there's a weekend in the middle, so probably by next Thursday. :-\

If it's a Louisiana state thing, I have no idea what their rules are.

I understand your frustration - believe me - but there's much worse things in life and lots more important things to worry about. As mentioned above, someone with a same or similar name, or their computers might have been down, or any number of things.

I chatted with my dealer one night after a fellow left, pretty upset with a "delay" response. He said he's had them call back with a "proceed" half an hour later (usually right after the customer left the store), never heard back, and everything in between.

Take a deep breath, have a cold one, and read some of Charlie's stories. Always improves my day!
 
Remember, the same Gov't runs the Post Office, need I say more.
 
Who is this oldman45 guy, anyhow? Even the name sound suspicious.:D

In Georgia we pay our money, let them make a copy of the GA DL and the GFL, and leave with the gun in hand. We went through our background check when we got the GFL.

There's your problem right there bunky. The Gubment wants to know how you managed to have that enormous illict amount of cash available. We're in a recession and they would like you to donate a portion of it back to them.:rolleyes:

I am use to being "Flagged". In Orange County, Florida there is an indiviual with the same name as mine. We have different social security numbers, different date of births,heights, weights, physical descriptions, and I am a anglo-saxton, and he is an african-american. He is a career criminal and I am a career LEO. However I have to submit to another latent prints check occasionally to verify that I am the right Jimmy.
 
This has happened to me on occasion when I don't use my social security number. When I use it-I have never had a problem. (Of course you have to know your ffl)
 
It rubs me the wrong way since I am clean enough to have a CCW from three agencies and serves paper for State Judges, a Notary Public for seven parishes and have a gun room in my house but have to wait to get a gun that is bought and paid for.
 
In MT the call goes to the Coast Guard as I understand it. ss# clears or it doesn't. Have you checked for identity theft with credit cards/loans credit apps, etc.?
 
It much suck to be a victim of the government, huh? :D


A plus of the NC carry permit is you didn't have to deal with (non)-insta checks on handgun and long gun purchases.
 
Not sure what you mean by "called in to the FBI". If you mean the national instant check that is one thing, if you mean that the FBI called you in for a visit, that's a different matter.

National instant checks as noted are allowed three days. Doesn't matter if you're Johnny Axe Murderer, if the Feds don't deny it in three days, you get the gun.

Next problem is that the dealer shouldn't have taken your money until the purchase cleared.

Are you a sworn LEO with an agency or just a process server? You say commissioned by the state, but do you mean as a LEO or as an officer in the state militia?

Five guns in a year isn't a lot. If ATF suspects you're up to something, they'll simply come to chat. I've bought five or more guns in a day and haven't been visited. Shrug.
 
I had a good friend up in Missouri who was a retired LEO. Every time he bought a gun the NICS system would put him on hold for three days.
Why?
Because he had a Police Record! :rolleyes:

Actually they SHOULD collect the money before the call.

Picture this......... You work at a gunshop. Guy walks in and say's "I'll take that one". He fills out the paperwork and you make the call. After the call you say "well sir you got delayed/denied. That will be $40 for doing the paperwork". Do you really think the customer is going to give up $40? No, they usually don't. If you pay prior to the call and get delayed, denied, or simply change your mind you MAY be charged a processing fee and/or a restocking fee. It's only fair.

I have made many calls to NICS. Seen them delay folks simply because they were busy or behind.

This is just the way the system works. No need to take it personally.

Clearing this up, the seller stated they call the FBI. I am sure it is the NCIC for an instant check.

I am a sworn officer for the state in two ways. I am a consultant to several agencies in the south and was commissioned and post certified in order to have some needed authority. Next off, I am a sworn officer of the court since Judges will ask I locate and serve individuals that I had contact with during some type investigation or work related instance. When I serve these papers, be for whatever reason, I have to state in writing that I am a Deputy Sheriff and authorized to serve the paper as directed in the Order of the Court.

And I do not remember ever buying five new guns in a year.

All the credentials in the world have no bearing on a NICS check. To them you are simply a name and a number.

I have called in NICS checks on LEO several times and they have gotten delayed.
 
I was surprised to hear that the presence or absence of a SSN on a 4473 could play a role in this, but maybe that ties into why gun dealers in in California tell purchasers NOT to fill in the SSN blank. Since residents of this state look at a 10-day hold on any purchase unless we have some applicable variety of FFL, the presence of a SSN wouldn't cut the hold time at all.
 
It would be interesting to know how many other LA would-be gun buyers had their purchases delayed today. YouKnowWho is reportedly commuting back and forth to "monitor" the oil spill.
 
A friend who's plain vanilla Anglo-Saxon with a clean criminal record and an AZ CCW, has a name right out of a Black-sploitation movie, and would, these days, have an "Ice" prefix were he in showbiz, routinely gets "held" because his name apparently matches that of a number of "gangstas". So far, this has been cleared up in a matter of a few days. I imagine that if some indentifier on your 4473 matches any prohibited possesor's, you may be "held" until some questionably competent bureaucrat gets around to sorting it all out...

If he keeps having that problem he needs to apply for a UPIN. (Unique Personal Identification Number).
 
I wouldn't be half surprised if they called in the morning and
said to come get it..
I had the same thing happen the last time I bought a new pistol.
It was late in the evening, and when they called it in they ended
up putting me on a hold. They said it either means they are busy,
or for some reason they want to do further checking.
The guy at the store said it was pretty common to get holds, and he
said it's often because they just get busy.
In my case, they called me back the first thing the next morning and
said come and get it. It was an Academy store that I was at...
I think the guy was just giving you the standard "government" answer
to how long the hold could last. if you didn't get it tomorrow, I would
be surprised. No way it should take 15 days, and even three days
would be snails pace compared to what they seem to do usually.
Then again, maybe something is different from LA, vs TX, but I don't
think so. They are both using the same national system.
 
Does Louisiana Law not take CWP as a wavier for a call to NICS??
