I just finished reading Judge McGlynn's decision on the IL Assault Weapons/High Capacity magazine ban. While I expect an appeal to be filed during the 30 day stay, and the 7th Circuit has not shared his reasoning in a case involving a similar municipal ordinance, I think the decision is clearly in line with Heller and Bruen and will eventually be upheld. This judge has educated himself not only in the law, but in the function of firearms and the distinction between their military and self-defense functions. He even cites David v. Goliath and the sword fight in Raiders of the Lost Ark.

For those who don't find 168 pages of legalese leisure reading, here's a link to a SAF release, with a further link to the decision.

And a pretty good summary on Yahoo which indicates that the state has filed a notice of appeal.

This will likely change nothing.

It will be upheld most likely. Sad, as the gun stores in Illinois are suffering as much of their business was dealing in assault weapons before the ban.

My guess is it gets reversed by the seventh appellate, which is becoming as much of a cir3cus as the ninth. But that's ok, SCOTUS will find them all unconstitutional when they take all the cases together in the next session.

Most especially liked the following quote from the ruling...

“Sadly, there are those who seek to usher in a sort of post-Constitution era where the citizens’ individual rights are only as important as they are convenient to a ruling class,” McGlynn wrote in his opinion. “The oft-quoted phrase that ‘no right is absolute’ does not mean that fundamental rights precariously subsist subject to the whims, caprice, or appetite of government officials or judges.”
