Is the 15-22 an assault rifle under CA law?

I posted an extra 10 round 15-22 mag on ebay last weekend and recieved a email from ebay that they pulled my listing because they don't allow accessories for assault weapons to be sold on ebay.
They provided links to the California Law and their policies concerning this and I read over the info.

Nowhere in these links did I find any specific mention of high capacity magazines or specifically ANYTHING about .22 caliber rifles.
There is 2 vague statements that say something about "looks or resembles an assault weapon" and "no matter the caliber."

How does this apply to the 15-22?

When I talked with the ebay rep he stated that they were not taking sides in the gun debate, then I pointed out to him that I have been selling these items for a while without any issue to this point and I feel that they have caved to the gun issue DISCUSSION(not law yet!).

Just curoius how this should affect me in Florida trying to sell something that is LEGAL in 50 States.

"no matter the caliber" should give you a hint. .22RF is a caliber, and 5.56 nato is a 22 rifle. Another thing is will the 15-22 accept a magazine holding more than 10 rounds, and does it have any attributes of what California considers an assault rifle?

Under CA law the 15-22 is not an assault rifle.

So when I talked with the ebay rep, in Southeast Asia BTW, he said that since I questioned them pulling my listing he would "forward an appeal to the investigating team" about this. I should receive an e-mail within 72 hours and be able to talk/discuss directly with the team.

Also wondered today if i could list the magazine as "10 round m-p 15-22 vanilla wafers with dispenser." Of course the vanilla wafers would have m-p 15-22 inscribed on them and be posed in the pic leaning against the mag, oops I mean "dispenser."

I just look at it this way there sight there rules. I agree with you should not be a issue but they own the sight and make the rules. I say just find some where else to list the mags such as gunbroker

Yes, they are legal in CA. And eBay can decide their listing rules as they see fit.

Which is why, several years ago, when they had their "no parts involved in making a gun fire" rule, I canceled my user account with a letter of protest and haven't looked at their site since then.

For many many weeks, when searching M&P 15-22 on eBay you would get 200+ listings over many pages. This morning I looked, I got 18 in total. They are killing off anything and everything it seems.

It may not be an assault rifle under CA law but as near as I can tell, it is under the law that NY passed yesterday.

When I went to the NY state website, it looks like all semi autos, either rifle or pistol, that use magazines are now considered assault weapons.

That puts my Ruger SR22 pistol in the same category as and AR15.....

They make their own rules and they will suffer the financial pain of being stupid.
