man shot for texting in movie theater

In Florida, it's apparently a felony to assault someone over the age of 65.

There was another story in the news just today out of Florida, about a fight between two senior citizens in a WalMart checkout line over whether more than 20 items are allowed in the 20-items-or-less line.

No shots exchanged; the objecting gent intentionally struck the too-many-items gent with his shopping cart, "causing pain." He was arrested and charged with felony battery on a senior. The perpetrator was 77; the victim, 67.

Curiouser and curiouser.

Both were very focused on their "rights" Thank God no one lost face....

I don't pretend to know what happened, but my guess is the above might have more to do with it than anything else.

Both these guys were with their wives. Some men will do whatever it reasonably takes to avoid escalating a situation because their family is with them, while others will never back down because their family is with them. Two guys who had something to prove in front of their wives? Wouldn't surprise me.

Or... it could be just an old man off his meds who got himself all cranked up reading Internet forums about how cell phones and texting was destroying western civilization and life in America as he once knew it....

I would disagree with that because the old man should have had the sense to leave it alone after he went to speak with the manager. The dead guy should have had the common courtesy to just put his phone away. Both of them should have been adult enough to come to some resolution without a physical altercation.

Hi Rastoff,
I'm just saying, if the man had not displayed rude behavior, even after being asked not to, the incident wouldn't have happened. Not that he got what he deserved, just that his behavior was somewhat responsible for what happened. Weather he deserved it or not, he wasn't shot for no reason. He was shot as a result of his own bad behavior.
Thanks
Mike

OR...it could be just a 40 something man off HIS meds trying to bully the wrong old man.

They that sow the wind shall reap the whirlwind.

Don't interpret that as me saying the guy got what he deserved. And it might have been the other way around if the younger man was armed and felt threatened or was trying to prove what a bad *** he is.

Both the guys were stupid. Their actions brought ruin and misery upon both their families. And for what? Rude behavior involving texting during a movie and throwing pop corn.

Idiots.

You can never read these stories from anti-gun media, you are assured of getting the facts wrong.

One of the articles I read went so far as to finish with a blurb about the Aurora theater shooting. Huh?

This stuff has being going on since the beginning of time and always will. If there were only two people left on the earth, chances are they would end up in battle over something.
It sounds like a sad thing all the way around.

Is it not true that retire LEO do not need a concealed carry permit? Doesn't the feds have a law that allows them to carry almost anywhere without going through the CC permit/license/process, and restrictions, that civilians have to go through? In this case the shooter was a retired high ranking LEO, he was not a civilian with a CC permit.

So, your experience has taught you to just stand there and take a beating while being robbed? How sad.

I have the opposite experience. Get away if possible. If not possible, fight like a cornered wolverine.

Yeah right - That's my plan...

Judges, retired PO's, defense Attorney's and procecuting attorney's in the state of Texas do not need a permit-----that is according to the teaching I recieved on applying for a permit and going thru the class. It was also on the test which the state made out.
I didn't see where the cell phone guy was 6'5". But I know at the age of 73 not to take a beating---you are liable to end up dead.
I do agree---from what I am reading---it was a righteous shooting------could have been avoided if the perp had just stowed it.
Blessings

Just my opinion... Both of them acted like juveniles. The old man should have just sat somewhere else.

Then both parties could have enjoyed the movie, and a little girl would still have her Dad. Sad!

Throw the book at him!

Yes, I hear you. I agree that this was an example of two guys blowing testosterone at each other. Neither is completely innocent. Show me a fight where one person is.

I see stuff like this all the time. Not people being shot, but guys that have the attitude that they have to win every argument. That their manhood is somehow diminished if they don't get the last word.

The theater had 25 people in it. One or both of them could have moved just a few seats and this wouldn't have happened. This whole situation is so stupid it brings me to tears. What's that little girl going to grow up thinking? How do you explain to a 3 year old that her dad isn't coming home because he threw popcorn at someone?

I just have to wonder at what was going through the old man's mind to think that he had to kill this other guy?

I read all I could find on it on google. It was reported numerous times the victim was 6 ft 5"s. It wasnt reported how big the shooter was. Also a big deal was made on all sources telling the shooters background and not a word on what the victim did. It`s a huge thing that should be pointed out how this is a example of how the news sources use facts to bias their view and excite the public the direction they want you to side with. As my old man used to say many times, "Dont insult my intelligence!"

Just tell her the truth, when she's old enough to understand. Any adult with the smarts God gave a white-faced cow knows, anyway. Insult a stranger, tell him what his mother did for a living, or spit on him, you're taking your life in your hands. That is THE TRUTH, and no discussion of right and wrong or feel-good *****-dominated "education" will change that fact.

Disbelieve at your own peril.

BTW, we still don't know what happened in THIS case.

Lots of stories here in TampaBay about this event.

Yes, in Florida it is a felony to commit a battery on someone 65 years of age or older. The battery, according to witnesses, was throwing his popcorn at or onto the shooter.

The defense attorney says it's a self-defense case (none of the mental/PTSD/nut stuff mentioned earlier in this thread).

The shooter had a concealed weapons permit.

There is at least one witness who says the shooter gave her some trouble on some date in the past when she was at the theater texting and that he followed her as she left where he was and went to the womens restroom.

There may be more witnesses about the shooter's behavior in the past relating to cellphones in the theater.

That's the latest here in sweet old TampaBay.

He is in jail without bond----but that is not the end results and carries very little weight in the court.
I have read some but I have not read where there were 25 people in the theater.
Folks---if a fight breaks out it is best if you win. I don't know where some of you are from but most of the time around here--an ambulance is the end results.
You can whine and say people should learn.
This has been going on for 3500 years according to the bible and it will never end as long as this earth whirls.
Folks---it is dangerous out there and not a place for politicing if you wish to survive.
I will not take a beating from another for fear of my life.
Blessings
