Is the magazine limit overturned, or is it just an opinion included in the decision that the act is Constitutional?

Not so quick, ringo. The judge said that the rest of the Safe Act was not in violation of Constitutional principles.

He only shot down (no pun intended) the 7 round mag limit because it seemed to be an "arbitrary" number.

This is not a "win" for us in NY. A win would be normal capacity magazines and not this 10 round ****. Still a loss in my book but then again I have been carrying 10 round in my mag since the law passed. I do not follow stupid laws. I may get caught one of these days but that is the chance I take.

Do not forget this is not over by a long shot. No matter what side won it will be going up the ladder to a higher court.

If you want this judge in your state, you can have him.
This judge wrote one of the most incoherent opinions in any court, any where.
He basically said it's ok to ban firearms that have "evil features" because those features in and of themselves make the guns more deadly.
This one is going up the chain.

Oh, he threw out the muzzle brake ban(evil feature) because whoever wrote the Bill spelled it "break".
