I recently acquired a S&W Model 41 with the ejector indicator. This was sold as a complete pistol with the original box and paperwork. After paying for the pistol and just before it was shipped to me, I was advised that the original box was accidentally disposed of by the seller's family while away. I advised the seller to ship the pistol anyway and that I would decide what I'll do after I receive it. My question is, surely I should be entitled to seek some sort of compensation for the lost box which, as far as I'm concerned, was part of the original transaction? Comments please......

While I certainly would agree that you are entitled to something due to the circumstances, I simply cannot imagine -WHY- you wouldn't discuss that immediately rather than instructing the seller to hurry up and ship.

How much? Man, that would be a real debate and you'd probably get 20 different answers if you asked 10 people.
 
I agree after accepting the changed deal its hard to go backwards.
One option is for the seller to purchase another box, in my mind another box still not as valuable as the original.
At the end of the day the question is are you happy with the price you paid for what you received.
 
If I were the buyer, it would make a definite difference and a price adjustment would be in order. IMO, how much would depend on several variables.
It sounds like an older model (ejector indicator???) so condition and completeness of the entire package; gun, docs, box, etc. would be important to me and likely reflect on the purchase price unless it was so cheap to begin with.
 
When the seller notified you of the box situation, you probably should have asked for compensation at that time. An original box is a valuable asset to your gun. And finding an appropriate replacement box (if wanted) could be quite pricey and of course it won't be original to the gun. Good luck, I hope you are successful.
 
just so everyone knows, the 41 cost me about $800US and the pistol itself is in very good condition. Box or no box, I wasn't going to let it go. However, as I stated, I feel that I should be entitled to a price adjustment on the deal...

Yes,you were entitled to an adjustment,however if you got good value,which I think you did,the box shouldn't be a sticking point,and perhaps just a $25 adjustment to keep the deal intact.Few sellers are in collector mindset,or see cardboard as much of anything.Doubtful the gun price was going to 700.
It's pretty much a moot point now,since you accepted the modified deal and the gun is on the way.I'm sure that the seller thinks that it's a done deal now.I wouldn't expect a refund.Forget about it and move on.
My thinking is probably different from most here.A box means very little to me.It doesn't make a used gun into a virgin again.I sell off boxes except for new,unfired guns.The condition of the gun itself,is everything to me.

Hi Kidcom,
I have been on gunbroker for the last month and all the 41's with cocking indicators are going for over $1,000 without boxes. You got a super deal without the box. If you feel an honest mistake was made I would accept their apology. and thank them for the good deal.

Thats what this gun is worth by itself. With Box it could have been as high as $1150. to $1200.00. As there is no box available for it You have done a fair deal for the price involved.
 
The OP had a deal for the gun with box and papers @ $800. What he received was less than what was bargained for, regardless of whether or not $800 for the gun alone was a good deal. The boxes for the cocking indicator era Model 41's are not inexpensive when they show up on ebay. I would ask for a $100 adjustment. If the seller balks, I wouldn't feel as bad as if I had paid $1100 and then didn't get the box, but a contract was made and broken by the seller.
 
Missing Box

I would tell the seller that a box and accessories are worth about $100, but that since it was an accident and not a deliberate deception you would like a partial refund, say $50 or so. Like everyone says, you still paid a fair price for the pistol.

A few years ago I sold a nice rifle to a gentleman online, and he called me and said the stock had a small hairline crack which honestly I never saw. He didn't want to return the rifle, so I shipped him a medium quality scope and we were both OK with that.

As I see it you have a dilemma, you bought a M41 + box for at a price considerably below market assuming the pistol is in very good or better condition.
The dilemma is that you will be hard pressed to find another pistol at that price even without a box.
If I were the seller I would apologize profusely for the accidental destruction of the box and ask you to return the pistol. What then? The seller can get at least his $800 without the box, can you find another M41 at the price?

I have a great pile of boxes going back to the mid-sixties, when I pass to the great gun range in the sky, my wife will toast marshmallows over the S&W box fire. She does not keep her shoe boxes and does not understand why we have hauled empty firearm boxes all over the US.
 
I think the women of to-day are part of the ME Me Generation as my wife only thinks her stuff has any value at all. According to her all my stuff is Junk. I do have my toys tho and she does not.
 
Well a resolution has been reached with the seller of the 41. After I explained my position on the situation, he apologized and provided me with a $100US refund on the transaction. I of course accepted his apology as well as his refund.
