Thief/gunman, and victim, both charged

But can we call him "kid?" He never went to court.

I am of the opinion that if he took the gun away from the man who shot him the other man could and would try to take it back. I am not sure that struggling with someone who just shot you and coming away victorious constitutes possessing a firearm.
 
American Citizens need protection under Federal Law. Any convicted Felon shot while engaged in criminal activities should be a freebie- no indictment.
You should not be at the mercy of the political activist prosecutors. You have risked your life once confronting the felon, no double jeopardy.
 
Sounds as bad as the case in Saratoga Springs, upstate. They charged an off duty Vermont deputy with attempted murder, as well as pile of new technical charges.

The six guys who beat and shot him, and chased the ambulance to try again, were only charged with attempted assault.

Allow me to take exception to your comment. The knucklehead got himself involved in a bar fight. After he was shooting up the street the police arrived. He ignored the order to drop his gun, and pointed it at the police. He was in turn shot by the police he threatened with his gun, and rightfully so. Sheeshe...he threatened the police with his gun, even in NY that should get the customary response of being shot. The guy deserves what he gets.
