My Pistol Brace Decision...

Well, I was one of those 300K Americans that decided to file an ATF Form 1 to register my SIG MPX with PAB as an SBR. Back in Feb/Mar/April/May, I watched the news and YouTube to see how several lawsuits against the ATF's PAB ban were progressing, and it was getting discouraging. Just before the "grace period" ended on May 31, I filed my ATF eForm (to take advantage of not having to pay the $200 fee). I just received my "Approved" form from the ATF via email on Aug. 16 (10 weeks of ATF processing- not bad!), stating that I now had a registered SBR. I'm OK with my decision because I can now shoot my modified MPX anytime without worrying. And I can put whatever SBR accessories I want on my MPX. I still hold out hope that the ATF's PAB ruling (and their other ridiculous rulings) will be overturned by the Courts.

Have you setup a Trust so you can pass it down after your death?
 
I've already had a few approved, still waiting on a few others. The real benefit of these is that you can easily change them back into pistols and taken off the NFA rolls if you so desire. We don't have to engrave them, so there is no financial loss if you decide to part with it down the road. So yeah, slap a stock on it (notify the ATF accordingly) and a vertical foregrip and enjoy your tax free SBR. If the courts end up siding against the ATF hopefully we'll be able to keep them as SBRs, but I think that's a big "if" for the gun rights crowd. If not, we can always change them back into braced pistols.
 
I thought about doing it, but I didn't want to raise my hand and say to the ATF "hey, look at me, I am one of those gun nuts you hate so much".

Same reason I haven't convinced myself to get a supressor yet. I am still on the fence..

According to my "approved" registration form, the only constraint I have is to comply with ATF Final Rule 2021R-08F. The Final Rule states I can modify my SIG MPX (now officially an SBR) any way that I like without notifying the ATF. And yes, it will get a folding collapsible stock in the near future.

If putting a stock on it changes the overall length then you will need to advise the ATF of that.

FAQ from their website:
Q: Once the firearm is registered as a short-barreled rifle (SBR) can I remove/change the “stabilizing brace” or attach an item marketed as a stock? If so, am I required to notify ATF in advance?
A: Yes, once the firearm is registered as an SBR, you can change out the “brace” device or stock for a different brace or stock. You do not need to contact ATF/NFA because changing the brace/stock does not change the configuration of the SBR. However, if the length of the firearm has changed you will need to notify the NFA Division.
 
Yeah, I hemmed and hawed about "registering" my two braced AR pistols, but reasoned that I am already on their radar since at the time I had a suppressor in "NFA Jail" and have filled out more 4473's than I can count.

The Form 1's for the SBRs and the Form 4 for the can were all approved within weeks of each other. My only concern is that the Form 1's are marked approved "Pursuant to ATF Final Rule 2021R-08F", and I wonder if this approval will be terminated if and when the rule is overturned.
 
I live very close to tn state line and travel out of state far to often to shoot longer yardage or to hunt with to screw around with the extra paper work required for a SBR when you plan to go out of state .

Beside I don't care to gave the feds any extra paper work that can make for a list of easy pickings with in area if a item is deemed illegal to owned. Sorta like those items like the one time legal forced reset trigger ?
 
IMHO, use of the term "Persuant to ATF Final Rule 2021R-08F" possibly means that if (when, hopefully!) the rule is found to ultimately be unConstitutional (which it clearly is!), then all bets are off...?

In other words, the so-called "FREE!" SBR amnesty registrations will also be revoked and anyone who actually has a SBR (as stated by them in their application or subsequently modified) will be obliged to re-register it and pay the tax or face possible investigation & subsequent prosecution.

It's a WIN-WIN (bureaucratically) for the ATF either way: thousands of new criminal cases to investigate with all the info needed right at their disposal and already "on the books". They'll need million$ more funding and thousands of new agents to clean up their mess!

All one has do to is convert it back to a pistol. You can either put the brace back on (assuming you replaced it with a stock), or in the case of several of mine, I can go back to a simple backplate (AP5, Stribog, Scorpion). No one is required to keep an SBR in that configuration, and can easily remove it from the NFA with an email.

Some of y'all are pretty paranoid. I personally don't see how calling a brace a stock is unconstitutional. If people are shouldering them, then they are stocks... it really is that simple. Whether or not the NFA of 1934 is Constitutional is another matter, but not one under debate in any current court cases that I'm aware of.

If Congress is banning something that has been highly regulated since 1934, we've probably got much worse problems to deal with.
 
I'm pretty sure another "constraint" is you cannot transport the SBR across state lines without prior notification and permission from the ATF.

Could be but there probably looking for Marijana plants or around were we live it could be the military just getting some low altitude mountain fly time.

Contacting/filing with ATF just puts one on the short list of knock at door if comes to that...in 'my' opinion. If ATF can 'make' laws, they have far reaching authority past their job description. Now i'm on list for this post?
