Finally!!! 5946TSW found *Thank you Smith and Wesson! Range report on Pg. 8*

My message to customer support:

I won this auction on 12-16-09 using Buy Now. I promptly sent payment, within an hour of winning, with a USPS MO via USPS Priority. Payment arrived but pistol didn't ship. After a week I had to contact him to see what the hold-up was allowing for the holidays. He stated he hadn't received my FFL although I'd called him the morning I'd won it, verified that he'd accept a faxed FFL, then faxed FFL, followed up by phone to ensure that he'd received it, and he stated he had it in his hands. Re-faxed FFL as soon as I learned this. Pistol finally shipped and was received on 01-05-10 was not the same pistol in the ad.

-The serial # was different.

-The condition was very bad compared to item pictured.

-Pistol had rail removed, pistol in ad had rail.

-Item has been relisted two more times using the same pictures.

-I asked for an exchange and seller stated he had no more but has since relisted same item. He did offer a refund but I am unsure if this would have covered all related shipping expenses.

-I then asked for a 10% refund to make right the issues with the pistol I received and seller agreed to only to 5%. I reluctantly told him that we'd be square then since he was at least attempting to meet my request.

-I have photos saved of the auction pistol and the one I received.

-I have since shipped the pistol to S&W for $49 via Fedex Standard Overnight to hopefully be brought up to correct condition depending on estimated cost.

-I understand that I agreed to keep the substandard item and my issues are likely being resolved through my own doing and expense however he continues to list the item using the same pictures and the second listing has already been sold. I fear that at least two more people are going to get scammed by this seller if the matter is not at least looked into.

-I feel that I should edit my feedback to reflect what seems to be blatant misrepresentation.

Sorry to keep bumping this but want to keep somewhat of a record.

After I requested an exchange for the pistol you relisted another one on 01-08-10 using the same pictures. You'd also relisted one on 01-02-10 using the same pictures. I'm likely SOL and I've pretty much accepted that however the people who have since bid on the same pistol I did and future buyers need to be made aware of your less-than-honest business practices.

I have sent the following message to Gunbroker Customer Support in order to edit my feedback regarding the transaction:

I regret that it has come to this as I'd stated we were square but you continue to list the exact same gun with the exact same pictures. It's truly sad that your need to make money outweighs your desire to be honest in your transactions.

Tell him you want the one in the current ad. He obviously has it in stock, right? When he says no, move on. You complained to Gunbroker and they will do whatever they want. You got ripped off by the guy but since it is a S&W, the factory will get the gun the way you want it at a fair cost price and you won't have been badly burned.

I doubt he is reading this thread or cares what any of us think or say.
 
I'm glad you are keeping us up on this scott. I was looking at a TSW on gunbroker but the seller had "MO or Bank check only" I decided not to. Once you send that out to a stranger you are Dependant on their honesty to not just cash the check and call it a day.

At least with CC or PP you have some recourse should you be getting ripped off. ****ty deal

I am 100% sympathetic the OP as I am both a buyer and seller on GB with over 150 A+ transactions, along with the same rating on many different gun boards. I post this for the newbies to GB. Don't give up on a great place to buy and sell firearms. Yes, there are shady dealers, this being one and I have personally seen another deal gone bad. But that should not detract anyone from buying firearms from GB. Hey, I am not a GB hack, just someone that is currently selling and I hate seeing the new people get discouraged by reading about deals gone bad on that site. I can link you to a thread on THR that is pages long about stupid gun shop owners and the people that work there. Not much difference in my mind except you pay way more than you should. Granted, gun shops do provide services that buying online can't, I am just saying bad gun buying experiences can happen anywhere. I can only speak for myself, as a seller on GB and other gun forums, I take pics of the exact firearm I am selling. I answer every question to the best of my knowledge and I can say proudly, I have never had to take any gun back from a disgruntled buyer. I wish this had never happened to Scotter260, but sometimes people get jacked on deals. He has handled it very professionally and calmly, I might add, because I would not have done it the same way. I hope he gets some satisfaction from GB management and at the very least, they are aware of a shady dealer. rant over
 
Should I get excited about this?

Received a letter confirming that they received my "item for repairs" and that "Items in for repairs are generally returned within 2-3 weeks after receipt."

That's it, nothing about an estimate for other services that I requested just "in for repairs". Nothing about once payment is received work will begin and within x number of weeks item will be returned.

I'd sent it in with a letter requesting:
-the no charge rail attachment but to provide an estimate if there really was a charge,
-they check on the extraction problems,
-they check on the non-functioning magazine disconnect,
-they provide an estimate for refinish (which over the phone was $105),
-they replace the tattered Delrin grips with new curved Delrin grips if available and provide an estimate for that as well.

I explained in the letter that function was my priority but if the cost to get that 100% wasn't too much, I'd maybe have them go 100% on cosmetics hence my request for an itemized estimate for each procedure.

I also received my $20 refund from the seller today. His response to my email indicated he wasn't pleased with me implying that I was angling for something more. I also modified my feedback although likely not as harshly as some of you have suggested.

I had to send my wifes 952 in for some work. They sent me a prepaid UPS label and said they would let me know what was wrong in about a week. I called them after 9 days and asked when they were going to get around to looking at the gun. The guy replied that it was on its way back. The gun showed up that day fixed, but no correspondence, or notice that it had been fixed or shipped. Works great, but the communication was very lacking. Hope your repair experience is a good one.

Here's an idea--don't get mad--get even. Post the guys e-mail address here on the forum and ask every member of this forum to bombard him once a day for at least a week with disparaging e-mails, i.e., fill his mail box so he can't correspond with anyone. If nothing else the jerk will get the idea that ALL customers,new and old, should be treated with respect and honesty.

Let me know--I'll send him the first e-mail.

What must be remembered is that while the item was misrepresented and has been offered two times since is that he stated that in my instance it was an oversight which I cannot disprove, he did offer me a refund right off and I chose to stick with the product while accepting a small refund. In my opinion a civil agreement has been reached and that is really the end of it for me so I have a hard time dragging him through the mud. I suppose I should just quit posting about it but I'm just giving updates on the "aftermath" at this point not intending to further stir the pot. I also don't see what else GB can say other than that a refund was offered and I declined. The only issue they may have is with him continuing to offer STS 5946s while using a 5946TSW picture and I've brought that to their attention.

I truly wish that whomever bid on the second one and possibly the third (I haven't checked to see if it's gone yet) would chime in with their experiences but I have no way of knowing who that/those party/parties is/are.

The update letter from Smith has me thinking that it is quite possible that they may feel all issues with the gun are safety issues and will repair all the issues at no cost. Why else would there be no mention of estimates for service as requested in the accompanying letter? I have no expectation of them doing this as it isn't their fault as to the pistol's received condition.

I do appreicate everyone's feedback on this matter,

So, I called S&W today and gave them the work order #. I explain that I received the letter indicating the repairs would be completed and then asked if he had any idea when I could expect the estimate for the services I requested.

He advises that, "It's already gone to mail." He then asks what I had requested. I explain specifically - rail attachment (quoted at no charge), mag disconnect fix quote, extraction fix quote (I figured the previous two would be covered under warranty as they were possible safety issues), refinish quote, Delrin grip quote - these being the issues that I felt would get the thing 100%. He stated that according to his info everything had been completed and the pistol was going out yet today. He ended with, "You'll have it Thursday."

I told him they were absolutely out-of-hand and their service wasn't even within the realm of reality. I then thanked him profusely. UNREAL!!

Needless to say,I will only be recommending S&W products to anyone that asks within earshot of me well into the foreseeable future. In fact, if we had any form of mountain around here I'd be up there now shouting their praises.

S&W has always treated me right, out of 8-9 things sent back over the years (for minor things), they only charged for one-a bent ejector rod on a Model 10.
 
been watching this for a while. glad to see it will all work out for you. unfortunately,gunbroker is very lax in their policing of sellers and there are more of them out there all the time. doubt if gunbroker will do anything to the guy, after all, they make money for each sale and they won't cut their own throat . have bought several items on that site and had fairly good luck,not nearly the problem you have had,but it still is aggravating when the deal doesn't happen as it should for all the parties involved,not just the seller. hope your new gun shoots great.
 
Any FFL's out there?

If he is misrepresenting firearms----selling firearms other than as described--shouldn't ATF get involved ? How can his FFL paperwork be correct ? Something really does need to be done to this guy--if for no other reason than to protect the rest of us.

After many lengthy discussions with my FFL about shipping and such you do not want to try any shortcuts of any kind and the Fed's don't mess around. He had a very unknowing innocent mistake on his part and they darn near shut him down.

What do the rest of you think--isn't it kind of like letting the rapist walk because we don't want to get involved-------until----------maybe ------it's our daughter. Something to think about.

Seems we had similar experiences. Call to check up on the gun, and its already finished and on its way back. Glad it worked out for you.
 
WOW - that is good to know if I ever need service. Can't wait to hear about what they did :)
