Is Snowden a traitor or a public servant?

I see your a cop or ex cop. Aint we splitting hairs here? Okay, lets say your backing up a prositution sting and hiding in a motel closet. Your partner brings in a john and you listen to the transaction and the boggie man comes out of the closet, right? What is that? Isnt it spying on free speech? By the way, unless its used to save lives I never belived in stings.

No, it's not. Why? Because a legal and Constitutionally Recognized court, SCOTUS said it's legal. They are the arbiters of the Constitution. Did you miss the point about the NSA's actions had been ruled illegal and an injunction to cease and desist had been issued. How do you support just ignoring it?

Now, inducing/entrapping someone to commit a crime is unconstitutional.

I really think you are completely missing the point. If you wanted to cite an a comparable example, it would be the police knocking on doors of entire neighborhoods, wire tapping phones and violating rights hoping to find one of many persecuted who was committing a crime.

Read this and tell me you think the Government spying on people in order to gain advantage in a lawsuit is National Security.

Feral,

Just to make sure we don't get on the wrong foot, we disagree, but I enjoy the civil back and forth. Thanks for that.

My problem with all of this is that the media and those in Congress that are commenting do little to convey that the very same oath they say this person took as an employee of the CIA and later a civilian-contractor for NSA is the one that ALL of our Congress members and our President took. Fat good it did this country. How many of those that took the oath have lied to the media, lied to Congress and lied to each other in their breach of the US Constitution and upholding it via their oath-taking? This is the mere tip of the iceberg..............

No problem S&W45colt. As I said earlier I dont have enough info to have a fast opinion, just going by first impressions where I thought snowden had just reported that the gov had developed the tools that enabled them to spy on us if they wanted. I didnt know they already had been caught, warned and still are doing it?
One question though: "Now, inducing/entrapping someone to commit a crime is unconstitutional." Am I to really belive that there hasnt been major uncountable stings on prositution and drug stings that " inducing/entrapping someone to commit a crime " isnt done daily all over? Isnt that the very basic discription of how a sting works?
I guess I watch too much tv and read the papers too much.

its some of that fine line stuff as I understand it.
take a prostitution sting ...
the john can walk away before the transaction. he's just not very prone to doing so.
in entrapment it might be a situation of a larger scope .. a cop wants some guy and can't connect the dots but holds pressure upon him till he agrees to do something illegal that the cop can stick to him. In this case, "pay the call girl and this thing I suspect you of goes away"
even though it, the letter of the law, never was to begin with.

if he isnt already .. I suspect he'll be quietly pushing up a new crop of wild flowers within a week.

I expect this thread to get locked/deleted...however,

there are certain things to me that don't make a whole lot of sense. I figure there is a more NOT being told than is about this issue.

First: Is he a traitor? If he isn't now, he will be. Hong Kong in this time is a wholly-owned subsidiary of the PRC. This means that he is not hiding, he is in the custody of or close scrutiny of the PRC's Ministry Of State Security. They are protecting him to find out if he knows as much as he claims. If not, he will be on flight straight back to the U.S. in very short order. If he is as he claims, then he would be a "cash cow" of intel and will be on a flight to Beijing in the very near future.

Second: Why did he run to Hong Kong knowing that in the first place? I suspect there is a lot more here than meets the eye. Especially since I believe there is an extradition treaty with them. Either he didn't plan this whole adventure very well, he's not that smart (ergo not going to be kept by the PRC), or there are other "issues" involved.

Third: I can understand his not wanting to tell our news media about this. With the way they have been acting, I wouldn't have, either.

Fourth: I do not compare this to the Wikileaks situation as it would be like comparing apples and oranges. I do, however, believe the same fate awaits all participants involved in both these matters.

Fifth: What he has in his corner, in my book, are the elected officials (well known to us here and I will not mention them) at the national level who are screaming the loudest for his head. Anything that they back should be subject to extremely close scrutiny.

Sixth and last: The US Government has been spying on its citizens for years. J. Edgar Hoover immediately comes to mind as well as several others.

Whether he is a traitor or not will be made clear in the next few weeks. All we have to do is be patient.

I hope this doesn't sound too political. If so, moderators please delete.

Yes, they put the programs in place without court clearance, based on the emergency need statue. Normally the court has to approve anything they do. When the court reviewed it down they road, they said it was unconstitutional and issued an injunction, which the NSA and the administration ignored. They also ignored the Senate Intelligence committees edict to cease until Congress could meet to discuss it and the court's findings.

Entrapment is such a fine line and complex I don't know if there is an exact answer to your question. I will say it depends on what level of L.E. you are talking about. A basic answer would be, all you can legally do on the local level is offer them the opportunity to break the law. You can put UC's on the corners etc and wait for them to drive up/offer etc. What you can't do is have someone knock on random doors and offer drugs at random houses. Is the line ever crossed? Without a doubt, yes, but thanks to the checks and balances we have, if their lawyer is smart enough to ask the right questions they skate at trial. A lot of them claim entrapment by the way, it's a common ploy, but the judge decides whether it was or wasn't and no judge likes to have rulings overturned for their mistake.

Now if you are the F.B.I under the new everything goes rules, you can overhear or discover a few idiots talking down the Government, say we ought to do something about it and get them acting on it. It doesn't matter that they are too stupid too to come up with the plan, you can give them the plan, tell them you can get the weapons for them, get the weapons, show them to them and then arrest them when they pay for them and take possession. The next step is then call a big press conference a tell everyone "We discovered a large domestic terror threat through our new resources and powers. This shows the Patriot Act and NDAA are good for you, don't you feel safer?"

By the way, the FBI story is not an example, it's an actual occurrence in my area of the world. The people they arrested couldn't plan a trip to the bathroom, were well known big talkers and would be lucky to find an open 24 hour Wal-mart on their own.

Hope that helps some.

Again, prove treason. Here's the definition according to the Constitution:

"Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court. The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted."

I don't see where he did any of that.

There is new stuff on this snowden thing every couple hours. I heard russia`s putin said he may try getting him asylum in russia if he wants it. I am trying to figure out what snowdens motive was. This guy was getting $220,000s a year doing what he liked! Is he falling on his sword for you and me on his principals? Or was he thinking he would get fast millions on a book and movie offers? Does he want to go down in world history as a marter? Or does he just want his 15 minuets of fame?
How much damage if any, was done? How much good if any, will come of this? So far I enjoy seeing certain people squirm.
Have you ever seen so many scandals before at the same time? I think we owe president nixon a appology.

Interesting that I see lots of quotes of the guy making $220k a year. The one news report I saw mentioned $122k. Not chicken feed, but vulnerable to transposed numbers. ;)

Amen. Nixon looks like a Choir boy, can you imagine what the press would be if this had been a few years ago?

I can't say what he was thinking, but he's got to be smart enough to know the book/movie is out, all the proceeds would be ceased as ill gotten gain under several different laws. He'll be lucky if he's alive in two years most likely, as for the other reasons who knows. I've got to ask you, the salary he had, a good looking pole dancer for a girlfriend and living in Hawaii? Would you do that for your 15 minutes? I can't see it. I'd have to go with truly thought he was doing the right thing or a martyr complex. I truly believe the guy and I'm a cynic because of my past experiences, but I thought my first wife was sane, so I'm no psychic.

Seems to me that our current government is spending more time and effort to watch "US" rather than "THEM".
Is there any wonder why we don't trust .gov?

Trouble is "them" is mixed in with "us" and "they" are not out there bit are here. I don't give a **** that the government knows what I say, I've got nothing to hide. If it means preventing another attack then the ends justify the means. Imagine the flack the government would receive for another successful attack, and they had the means to thwart it but did not? Don't hand me the quote that you can't have both freedom and security. Ben Franklin didn't have a cell phone and the Internet.

successful attacks ... you mean like Boston and Newtown when this program was all but certainly in place?
If thats what its for ... it isnt working and Ill have my Liberty back TYVM

Hmm.
The difference between him and Pvt. Manning is what?

Details ..... so far at least, all we know about Snowden is that he ratted on the government's spying program. I'm not aware of any real national security secrets he divulged?? Telling the world that the government is spying on its citizens does not constitute treason in my book...
