NYC spanked for "Good Moral Character" requirement for permits

circuit court judge in the southern district of New York ruled in unconstitutional under the 2A. It is subjective, and absolutely no historical basis for it. Judge had some great things to say about NYC for trying this garbage, especially after Bruen.

Flailing against the windmills here, I know, but this whole can of worms just reinforces what I just finished posting in another totally unrelated thread ;

It is wholly inadequate to the government of any other.” Morality and virtue are the foundation of our republic and necessary for a society to be free; the more our morality and virtue slip and diminish the greater our bondage and loss of freedom becomes.
I know that if you need one personally a lawyer can be a great thing; but a great deal of the ills we face as a society are exacerbated by those who reduce such questions to tying up the arguments with ridiculous absurdities quibbling over such as "it depends on what your definition of 'is' is" :rolleyes: . . . we've long since passed the tipping point - we're doomed."

Questions/assertions/definitions of "good moral character" by minions of our government from low level to high are meaningless because THEY have made them so. Traditional and biblical morals and standards the old fashioned 'dead white guys' who founded the country used and took for granted (even if they personally struggled to live up to them) are consistently ignored, dismissed and ridiculed by these people until it suits their personal bigotry/biases. Everything from parental rights to gun control to the size of a soda you're allowed to buy to what and where you're allowed to smoke to yada, yada, yada . . . they covet CONTROL and insist on laying their grubby phalanges on everything concerning someone else while they use it as a license to dictate to the rest of us.

Darn that pesky Constitution and the insistence of a few people left on the bench with integrity and intelligence that still fight the good fight in applying common sense to the written word and the intentions and meanings behind it. They can be so obstinate and frustrating ! :eek::rolleyes:
 
I would not count it as a “win” yet, by any means.
A future President Newsome will have other ideas.

Time marches on. Good justices, meaning the ones that think as we do, are limited. Same for good Presidents. The 6-3 SCOTUS is not forever and, historically speaking, there have been more than a few cases that were held as good law for years only to be overturned after decades. So you young whippersnappers out there better stay focused because the fight will never end.
 
The "good moral character" standard is thinking like the anti-gun people.

just so you know, historically, only .5% of SCOTUS rulings get revised or reversed.
 
Another part of NY’s new background check for firearms and ammo is they want your email address. They also want make model and serial number of gun. FBI NICS ck never asked for gun specific info. Just long gun or handgun……… Funny (not really) story in NY Outdoors News this week. A local county sheriff organized a trap shoot to benefit charity. He stopped by local sporting goods store to buy 2 boxes of shotgun shells. One for him and one for his daughter. His check came back as delayed. After 15 min it came back delayed again. He was finally approved 25 hrs later. After his event was over. Did I mention he was the sheriff ?!?!?!?!
This could open another can of worms. Could someone have lent him a box of shells with no background check? Again it’s a slippery slope here in NY. Hopefully all the legal challenges progress quickly
 
the FOPA of 1986 specifically prohibits building a database of firearms and owners. I hope that is part of one of the lawsuits.
 
…Funny (not really) story in NY Outdoors News this week. A local county sheriff organized a trap shoot to benefit charity. He stopped by local sporting goods store to buy 2 boxes of shotgun shells. One for him and one for his daughter. His check came back as delayed. After 15 min it came back delayed again. He was finally approved 25 hrs later. After his event was over. Did I mention he was the sheriff ?!?!?!?!

Unfortunately, I’ve personally seen at least more than a handful of delays with the NYS NICS check since it went active last month. There seems to be no rhyme or reason- from permitted law abiding civilians to active duty law enforcement officers. The delay generally clears within a day or so, but the area where we store “delayed” firearms and/or ammunition is getting more and more inundated lately!

NY has had so many morally bankrupt and corrupt examples. Most in the Governor's Mansion.

I dunno. I think one of them made it all the way to DC. I forget his name, though. Not a Governor though. I think he would up higher up than that though.... name escapes me right now.

Lower court decisions amount to a poorly aimed shot over the bow. An attention getter and not much more. Then the circuit court hoopla begins until SCOTUS hears--or doesn't hear, as the case may be--the case. Then it makes a ruling one way or the other. At that point, laws ruled unconstitutional are rewritten and signed into law again, and the judicial circus begins anew.

Mags are banned; mags aren't banned ARs are banned; Ars are not banned. You can carry almost anywhere; you can't carry anywhere. For years this has gone on at every level of the justice system all over the country, and still the answer has not been determined in its finality.

The NICS check is not going away no matter what the courts say.

There's no regard by the current blue state politicians of current laws or court decisions. They pass laws or make rules by fiat that should not survive in the courts, and either a) the judge goes right along with them or b) it gets struck down after YEARS of infringement, and the same politicians simply make a brand new law that's often worse than the first one --- and now have it in force for years once more.
 
Well Rockefeller (former Governor) was the VP under Gerald Ford. Cuomo was made the HUD sectary by Clinton.

Nooooooooo.... I think it was more recently. Could have bene even higher up than a VP.... name just escapes me though.
