Silencer tax is history

I have not seen the text of the change in the BBB. Nor what the BATFE will require, if anything. They will probably reconfigure the existing requirements, maintaining some form of registration. My guess is that they will just drop the tax stamp requirement and retain everything else.

The text says it goes into effect:

"(b) Effective date.—The amendment made by this section shall apply to calendar quarters beginning more than 90 days after the date of the enactment of this Act."

Based on my "math" that's January 1, 2026.

It won't matter in Illinois. In the last go-around, "silencers" were banned as well as threaded barrels. I'm mildly surprised that violin cases are still legal (I'm horrified at the thought of seeing naked violins downtown). Our legislators have learned all they need to know about "silencers" from Hollywood.

Since the NFA is strictly a tax scheme and the registration is for keeping track of the $200 tax, I am confident that removal of the registration process will be immediately sought in court. Without the tax the NFA is dead, at least as it pertains to silencers and short barreled rifles and shotguns.

I've read a few pundits that say this could be a double edged sword. If suppressors are taken off the NFA list then they are no longer considered firearms and therefore not protected by the 2nd Amendment. Potentially, states could ban them.

In a real, normal court that would be overruled & thrown out. It does nothing to alter the one-pull-one-shot process for us heathens. A decent lawyer would win that, as long as the judge was impartial.

Have you seen anybody successfully challenge California's ban on rifles with pistol grips, flash hiders, and/or bayonet mounts?

In a conversation today…..if they removed the tax why cant an anti gun admin bring it back someday in another Bill….say $5,000
They could do that...Just like they could have done it last year or next year...That option has never changed.

The key to this is not the $200, it is the fact that it has now become a tax/revenue law, now with NO corresponding tax.... This will be immediately challenged in court as a void statute.

My guess is that suppressors will eventually be purchasable with a 4473 and NICS.

I sure hope your guess is right.
