FIRST ON FOX: America's largest and longest-standing gun rights group is suing the Biden administration to stop new federal regulations on pistols with stabilizing braces, gun accessories that President Biden has called "especially dangerous" after they were used in two mass shootings.

The National Rifle Association (NRA) is challenging a move by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to regulate guns equipped with stabilizing braces, also called pistol arm braces, like short-barreled rifles, which require a federal license to own under the National Firearms Act (NFA). In a federal lawsuit being filed in North Dakota Thursday, the NRA argues that ATF's new rule is "arbitrary" and vague to the point of being an "abuse of power."

what is absolutely bonkers, is that other than AP US History as a hs sophmore, and 2 quarters of PNW History in college, I never really studied civics and government that deeply. But even with public school education, I immediately saw massive flaws and over reach in the ATF's handling of this, and the bump stocks.

It really mirrors common street criminals. They know it's not right, but they probably won't get caught. And if they do, they won't get in trouble. And if they do, it won't be much trouble. And then they turn around and do it again.
 
Waterson versus the ATF, one of the many lawsuits challenging the pistol brace rule has been granted an expedited review and a hearing has been set for March 24th.

It’s based on ATF’s lack of authority under the major questions doctrine, its violation of the Administrative Procedures Act, mis use of Chevron Deference, rather than applying the rule of lenity, and violation of second amendment under the common use doctrine by claiming braced pistols are “dangerous and unusual”.

The plaintiff is asking for an injunction against implementation and asking for a decision prior to the law taking effect.

At a minimum this has the potential to put the registration requirements on hold until all the dust has settled in the legal challenges.
 
Had a quarterly area LE information sharing meeting with ATFE this morning. This “rule change” was driven by two shootings and 100 trace requests regarding AR and AK pistols, with 20 to 40 million out there in common use. Draw your own conclusions. . .
 
2 out of "20 to 40 million" yup, obviously a dire threat to humanity.

Muss, I understand you need to be careful what you pass on, but did an actual BATFE representative acknowledge that the BATFE considers there to be between 20 and 40 million in common use?

I'm pretty sure industry records support that. Even if it's half the bottom number, it's pretty common . . .
